Decision:

Following Race 4 an Information was filed pursuant to Rule 871 (1) (D). The Informant Mr J Oatham alleged that Miss Hercock permitted her mount ‘Smacka’ to shift outwards near the 350 metres when insufficiently clear of ‘Allchat’ (M Sweeney) who was checked. 



Following Race 4 an Information was filed pursuant to Rule 871 (1) (D). The Informant Mr J Oatham alleged that Miss Hercock permitted her mount ‘Smacka’ to shift outwards near the 350 metres when insufficiently clear of ‘Allchat’ (M Sweeney) who was checked.  Miss Hercock admitted the breach.

Mr Robinson demonstrated the video films which showed Miss Hercock allowing her mount to drift out at the 350 metre mark and take the line of ‘Allchat’ when not the required distance clear.  Mr Robinson said it was not a bad case of careless riding but Miss Hercock was only a bare length clear of Mr Sweeney who had to ease his mount.

Mr Oatham said Miss Hercock had a good record with only 2 suspensions in the last 12 months and submitted this was at the lower end of carelessness.

The Committee carefully considered all evidence and submissions before imposing a penalty.  We took into account the following:

  • Her level of interference which we consider relatively low.

Accordingly we impose a suspension on Miss Hercock from riding in races to start after racing on 25 April 09 until after racing on 02 May 09 (4 days)
