Decision:

Following Race 2 an Information was filed pursuant to Rule 871 (1) (D).  The Informant Mr J Oatham alleged that Mr R Norvall permitted his mount ‘Santipo’ to shift outwards in the final straight when not sufficiently clear of ‘Sand Jewell’ (M Sweeney) who was checked near the 200 and 100 metre marks.

Following Race 2 an Information was filed pursuant to Rule 871 (1) (D).  The Informant Mr J Oatham alleged that Mr R Norvall permitted his mount ‘Santipo’ to shift outwards in the final straight when not sufficiently clear of ‘Sand Jewell’ (M Sweeney) who was checked near the 200 and 100 metre marks.

Mr Norvall pleaded guilty to the charge.

Mr M Williamson demonstrated the video films which clearly showed ‘Santipo’ move out on 3 occasions taking the line of ‘Sand Jewell’ when insufficiently clear of that runner. Mr Williamson said Mr Norvall moved out 4 – 6 horse widths when only ¾ to 1 length clear.

Mr Norvall said his horse was racing greenly but admitted his mount did move out.

PENALTY SUBMISSIONS

Mr Oatham said Mr Norvall had only incurred 1 suspension in the last 12 months but considered his level of carelessness was in the mid to high range.  Mr Otham said Mr Norvall kept riding forward and only changed his whip when the interference had occurred.  He submitted a 5-7 day suspension was appropriate.

Mr Norvall said he had commitments up to and including 25 April 09.

PENALTY

--

The Committee carefully considered all evidence and submissions before imposing a penalty.  We took into account the following:
• Mr Norvall’s guilty plea
• His riding record
• His level of carelessness

--

Accordingly we impose a suspension on Mr Norvall from riding in races to start after racing on 25 April 09 until after racing on 03 May 09 (5 days).
