Decision:

Following Race 1 an Information was filed pursuant to Rule 871 (1) (D).  The Informant Mr J Oatham alleged that Miss N Collett  permitted her mount ‘Pinstar’ to shift outwards near the 150 metres when not sufficiently clear of ‘John Gray’ ( M Cameron) forcing that runner outwards on to ‘Pocket Diary’ ( M Wenn).  ‘John Gray’ and ‘Pocket Diary’ were badly buffeted which also contributed to ‘Popsicle’ (T Thornton) being hampered.

Miss Collett did not admit the breach and was represented by her employer Mr R Collett.

Mr M Williamson demonstrated the video films which clearly showed Miss Collett move out approximately 1 -2 horse widths and take the line of ‘John Gray’ when not the required distance of that runner, being only ½ length ahead.

Mrs T Thornton was called as a witness and stated that 50 metres into the straight she received pressure from inside and outside.  She said Miss Wenn was angling out for a run and Mr Lammas was rolling in.

Miss M Wenn was also called and said she went for a small gap between Mrs Thornton and Mr Lammas which she was entitled to.  However the gap closed and she said she received buffeting for several strides when it became very tight.

Mr M Cameron said Miss Collett was ¾ of a length ahead of him when she moved out and made contact with him.

Miss Collett said in her statement that she didn’t think she caused the interference.  She believed it was before she moved out.

--

Mr R Collett said he believed the interference was minimal and Miss Collett had only moved out 1 horse width.

Mt Oatham summed up saying it was clear Miss Collett moved out 1-2 horse widths and kept riding forward with the stick causing interference to Mr Cameron.  He conceded however the interference was contributed to by 2 horses which made the interference worse.

DECISION

--

The Committee carefully considered all evidence and reviewed the video films.  We are clearly satisfied that Miss Collett did allow her mount to move out 1 – 2 horse widths and into the line of ‘John Gray’ when not the required distance clear.  Although Miss Collett did attempt to straighten her mount this was after the interference to ‘John Gray’ had occurred.  Accordingly we find the charge proven.

PENALTY SUBMISSIONS

Mr Oatham produced Miss Collett’s record which he said is of concern with Miss Collett having had 7 suspensions in the last 12 months.  He said there were some mitigating factors in her favour with 2 horses contributing to the interference.  He submitted a penalty of 5-6 days would be appropriate.

Miss Collett said she had commitments up to and including 25 April.

PENALTY

--

The Committee carefully considered all evidence and submissions before imposing a penalty.  We also took into account Miss Collett’s record and voiced our concern to Miss Collett over the number of suspensions she had incurred over the last 12 months.  In today’s incident 2 horses contributed to the interference which is a mitigating factor in Miss Collett’s favour.

 In weighing up all these factors we believe a penalty of 6 days is appropriate and accordingly impose a suspension on Miss Collett from riding in races from after racing on 25 April and concluding after racing on 6 May 09 (6 days).
