Following Race 6 an information was filed pursuant to Rule 871 (3) by the Informant, Stipendiary Steward Mr A Coles. He alleged that Mr C Ormsby, being the rider of CASUAL FIBS, made a celebratory gesture prior to passing the winning post.
--Mr Ormsby admitted the breach and was represented by his employer Mr J Pender.
--Mr Coles demonstrated the video films and showed where Mr Ormsby raised his whip approximately 1 1/2 strides from the winning post.
--Mr Ormsby said he misjudged where the winning post was and freely admitted his guilt.
--Mr Pender said Mr Ormsby had been wasting all week and it was his first win for him.
--Stipendiary Steward Mr Williamson said this was Mr Ormsby's first charge under this Rule and submitted a $300 fine was appropriate.
--PENALTY
--The Committee considered all submissions and before imposing penalty considered this was Mr Ormsby's first offence under this Rule, and his guilty plea. Accordingly we impose a fine of $300.
