Decision:

Following Race 10 an information was filed pursuant to rule 871 (1)(d) by the informant Mr M Williamson.  He alleged that Ms Wenn rider of IL PALIO permitted her mount to shift inwards near the 800 metres forcing KHEPRI (J McDonald) into the line of TIGHT GENES (S Spratt) who was checked.



Following Race 10 an information was filed pursuant to rule 871 (1)(d) by the informant Mr M Williamson.  He alleged that Ms Wenn rider of IL PALIO permitted her mount to shift inwards near the 800 metres forcing KHEPRI (J McDonald) into the line of TIGHT GENES (S Spratt) who was checked.

Ms Wenn admitted the breach.

Mr J Oatham demonstrated   the video films which showed IL PALIO ridden by Ms Wenn racing in a 3 wide position nearing the 800 metres, when she angled her mount inward when not the required distance clear.  As a result KHEPRI (J McDonald) was forced into the line of TIGHT GENES (S Spratt) who was checked and lost ground from the incident.

Ms Wenn said that her mount was pulling and she had made an error of judgment by angling her mount inward when not the required distance clear.

Penalty Submissions

Mr Williamson said that Ms Wenn had an excellent record with no charges in the last 12 months. He submitted a 4 day suspension would be appropriate.

Ms Wenn said that she had commitments up to and including January 2nd 2009.

Decision

--

The Committee considered all submissions and before imposing a penalty took into account

--

1. Her guilty plea

--

2. Ms Wenn’s excellent record.

--

3. Degree of carelessness.

--

Accordingly we imposed a suspension to start after racing on 2/1/09 and to conclude after racing on 6/1/09 (4 Days).
