Decision: Following race 7 information instigating a protest was filed pursuant to Rule 876 (1) when it was alleged by the informant , Stipendiary Steward Mr Oatham that FINCAYRA MISS or its rider Mr A Calder placed 1st by the judge caused interference to BOYDY’S  DREAM  placed 2nd by the judge

Following race 7 information instigating a protest was filed pursuant to Rule 876 (1) when it was alleged by the informant , Stipendiary Steward Mr Oatham that FINCAYRA MISS or its rider Mr A Calder placed 1st by the judge caused interference to BOYDY’S  DREAM  placed 2nd by the judge. The interference occurred in the final straight.

Following race 7 an information instigating a protest was filed pursuant to Rule 876 (1) when it was alleged by the informant, Stipendiary Steward Mr Oatham that FINCAYRA MISS or its rider Mr A Calder placed 1st by the judge caused interference to BOYDY’S DREAM placed 2nd by the judge. The interference occurred in the final straight. The margin between 1st and 2nd was a nose.

Stipendiary Steward Mr M Williamson demonstrated on the video films and showed that the horse FINCAYRA MISS shift out 3- 4 horse width’s, and on 2 occasions in the final 150 metres  make contact with BOYDY’S DREAM. In his opinion BOYDY’S DREAM momentum was clearly affected by the contact ,  of significance was the fact that BOYDY’S DREAM had made up 1 ½ lengths in the final 200 metres and only failed to win by a nose.

Mr Ormsby said there were 2 significant movements by FINCAYRA MISS onto his mount, in which BOYDY’S DREAM became unbalanced, he did not stop riding because it was close to the finish and he had victory in his sights.

Mr Calder agreed that contact occurred on 2 occasions. He said that Mr Ormsby did not stop riding his mount, and both horses were getting tired, and feels both horses contributed to the contact.

Mr Pender said it was clear his horse had received interference on 2 occasions and had no doubt this prevented BOYDY’S DREAM from winning the race.

Mr Oatham said there were 2 bumps, there was far more significant movement by FINCAYRA MISS onto BOYDY’S DREAM. In his opinion BOYDY’S DREAM lost considerable momentum at the point of interference and taking into account the margin of a nose, he was clearly of the opinion that BOYDY’S DREAM would have won the race.

DECISION

--

The Committee carefully considered all the evidence and submissions. We are satisfied that BOYDY’S DREAM did receive significant interference from FINCAYRA MISS in the final 150metres. This interference clearly cost BOYDY’S DREAM considerable momentum, and after getting balanced up again, it was clearly evident that BOYDY’S DREAM was taking substantial ground off FINCAYRA MISS in the closing stages, with the official margin between 1st and 2nd being a nose. The Committee has no doubt that had BOYDY’S DREAM not received the interference from FINCAYRA MISS it would have finished in front of that horse.

Accordingly the protest is upheld and the placings are now:
