Decision: Following race 2 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J Oatham, that C Leveque, rider of CHICKILICIOUS, committed a breach of that Rule when near the 700 metres

DECISION & REASON:

Following race 2 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J Oatham, that C Leveque, rider of CHICKILICIOUS, committed a breach of that Rule when near the 700 metres CHICKILICIOUS shifted out when not clear causing a check to HILLARY’S STEP (P Boylan) and also KARLOS (L Macfarlane).

Mr Leveque admitted the breach.

Stipendiary Steward Mr M Williamson demonstrated the video films and showed where at the 700 metre mark Mr Leveque angled his mount outwards and took the line of HILLARY’S STEP and a resulting check to KARLOS when not the required distance clear.  Mr Williamson showed where at the point of interference Mr Leveque’s mount had shifted out 3 horse widths, checking HILLARY’S STEP who was forced into the line of KARLOS who had to be checked sharply off the heels of that runner.

Mr Leveque had nothing further to add.

Mr Oatham produced Mr Leveque’s record which showed only one previous charge and submitted a suspension of 4 days would be appropriate.

Mr Leveque said he had no upcoming riding engagements.

The Committee considered all submissions and before imposing a penalty took into account the following:

  2. His guilty plea.
    3. --
  3. The severity of interference received by Mr Boylan and Mr Macfarlane.

PENALTY:

Accordingly we impose a suspension to start after racing on 25 July and conclude after racing on 6 August 2008, 4 days.
