Decision:

Following race one an information was filed pursuant to Rule 304.  The informant, MrWilliamson, alleged that Mr Ihaka did misconduct himself by using offensive, insulting and obscene language in the weigh-in areas.

Following race one an information was filed pursuant to Rule 304.  The informant, MrWilliamson, alleged that Mr Ihaka did misconduct himself by using offensive, insulting and obscene language in the weigh-in areas.

Mr Ihaka pleaded guilty to the charge.

Mr Williamson told the Committee that Mr Ihaka who finished fourth in race one, used foul language upon dismounting and continued this in an elevated voice into the weigh-in area.  Mr Williamson said this was unacceptable behaviour and cannot be condoned.

Mr Ihaka in explaining his actions said he should have kept any frustration to himself and been more professional.

PENALTY SUBMISSIONS:
Mr Williamson said Mr Ihaka had been totally co-operative with Stewards and had pleaded guilty.  However, he said it was a serious racing offence which normally would have attracted a fine of $750 upwards.  However, because Mr Ihaka was a highweight rider with lesser opportunities he submitted a fine of $500 was appropriate.

PENALTY:
The Committee considered all submissions and evidence, and before imposing penalty told Mr Ihaka this sort of behaviour was totally unacceptable and would not be condoned.  He was told several people heard his language with resultant complaints.  However, the Committee gave credit for Mr Ihaka’s guilty plea, remorse and co-operation.  Accordingly we impose a fine of $500.
