Decision:

Following Race 5 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Stipendary Steward Mr J Oatham that defendant V Ho  permitted his mount MISS  RAGGEDY ANN to shift inwards near the 50 metres when not sufficiently clear of ROUGH ODDS who was severely checked
 



Following Race 5 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Stipendary Steward Mr J Oatham that defendant V Ho  permitted his mount MISS  RAGGEDY ANN to shift inwards near the 50 metres when not sufficiently clear of ROUGH ODDS who was severely checked
 
Mr Ho, who was represented by Mr R Hewitson, admitted the charge.

Mr M Williamson demonstrated the videos. As the horses progressed down the final straight MISS RAGGEDY ANN was racing on the outside of ROUGH ODDS. As Mr Ho started to urge his mount MISS RAGGEDY ANN it could be seen to start an inwards movement. Mr Ho continued to ride  his mount forward without taking any remedial action and as a result Mr Walker had to take evasive action and his mount ROUGH ODDS was severely checked and lost several lengths.

Mr Oatham said that Mr Ho had been riding in Australia and this was his 2nd ride in New Zealand. He said he considered this offence was at the higher end of the scale as, in his opinion, ROUGH ODDS was denied the chance of finishing in a higher place than 4th. He asked for a suspension of 6 – 8 days.

Mr Ho had nothing to say except that he wished any suspension would start immediately.

After taking into account Mr Ho’s admission of guilt, his record, and the severity of the interference the committee suspend Mr Ho from race riding beginning after the finish of racing on 2 May till the finish of racing on 16 May 2009. (7 days)
