Decision: Following Race 10, an information was filed pursuant to Rule 871 91) (d) by the informant Stipendiary Stewart Mr J Oatham.  He alleged that Mr Innes permitted his mount MATHIAS to shift outwards near the 300 metres when not sufficiently clear of LUMINOSO (A Webb) who was checked.

Mr Innes did not admit the breach.

Assistant Stipendiary Steward Mr M Williamson demonstrated the video films and showed that near the 300 metre mark Mr Innes allowed his mount to shift out and take the line of LUMINOSO, ridden by Mr A Webb.  Mr Williamson said Mr Innes was approximately Âľ length clear of LUMINOSO when he took his line.  He said there was no run ahead for Mr Innes and he should have taken hold instead of moving out as he did.

Mr A Webb, rider of LUMINOSO, was then called as a witness and said he was improving at the 300 metres when Mr Innes shifted ground towards him quite aggressively.  He said Mr Innes was only Âľ length ahead of him and he had to check his mount and lose momentum as a result.

Mr Innes, in his submissions, said he believed Jason Collett, who was racing directly ahead of him, had moved out causing him to move further out than he intended.  He believed that if Mr Collett had not moved out there would not have been any interference.

Mr Oatham, in presenting his submissions, said that Mr Innes was not entitled to the run he elected to take and he was clearly not the required distance clear of Mr Webb when he took his line.  He also said that the slight outward movement by Mr Collett occurred after the interference to Mr Webb.

DECISION :

--

The Committee carefully considered all evidence and reviewed the video films.  We are clearly satisfied that Mr Innes allowed his mount to move out and take the line of Mr Webb on his outside when not the required distance clear of that runner.  It is further clear that when the interference to Mr Webb occurred, Mr Collett was keeping a straight line and only moved out after Mr Innes had taken Mr Webb’s line.  Accordingly we find the charge proven and Mr Innes guilty as charged.

PENALTY :

--

Mr Oatham said Mr Innes had a good record with only 1 charge in the last 12 months.  However, he submitted this offence warranted a penalty in the mid to higher range of carelessness.

Mr Innes told the Committee he had commitments up to and including the 25th October 2008.

The Committee considered these submissions and before imposing penalty took into account the following :

--

1.         Mr Innes’ riding record

--

2.         Level of interference committed by Mr Innes.  In this case Mr Innes was blocked for a run ahead, so angled out without regard to Mr Webb on his outside.

--

3.         Mr Innes’ upcoming commitments.

--

Accordingly, we impose a suspension for Mr Innes to serve from after racing on 25 October 2008 and conclude after racing on 31 October 2008 (5 days).
