--

DECISION & REASON:

--

Following race 3 the Stipendiary Steward, Mr J Oatham, filed an information pursuant to Rule 871(1)(d) when he alleged that L Callaway shifted inwards on PREEMO when not sufficiently clear of BOUQUET (L Hofmann) who was checked and lost ground.

--

--

Mr Callaway, who admitted the charge, was represented by Mr R James.

--

--

Mr G Stewart demonstrated the video which showed Mr Callaway, soon after the start, making progress towards the running rail from a wide barrier draw, and in doing so checked BOUQUET ridden by Miss L Hofmann who was racing one off the rails. There was no doubt that this movement was responsible for the check that BOUQUET suffered.

--

--

PENALTY:

--

Mr Oatham stated that although the incident was on the lower scale he asked for a suspension. He also gave Mr Callaway's record which involved 5 suspensions for careless riding in the last 12 months.

--

--

Mr James asked that Mr Callaway's riding in both islands be taken into account.

--

--

The Committee after taking all matters into consideration including Mr Callaway's admission of guilt and his poor riding record suspend him from riding from the conclusion of racing on 10 December until the conclusion of racing on 17 December 2006.
