Decision: Following race one an information was filed by the informant, Mr J Oatham.  This comes pursuant to Rule 871(1)(d) and it is alleged that near the 800 metres Ms Rathbone allowed her mount GENERAL MAC to shift in dictating GREY EBONY

Following race one an information was filed by the informant, Mr J Oatham.  This comes pursuant to Rule 871(1)(d) and it is alleged that near the 800 metres Ms Rathbone allowed her mount GENERAL MAC to shift in dictating GREY EBONY (J Riddell) in onto JAILHOUSE (C Ormsby) who was forced into the line of HIT AND MISS (P Boylan) who had to check his mount.

Ms Rathbone admitted the charge.

Mr A Coles, Stipendiary Steward, demonstrated the video films and showed where at the 800 metre mark and on the point of the turn, Ms Rathbone on GENERAL MAC and racing approximately 6 horses wide, allowed her mount to move in and in doing so crowd the horses on her inside.  The worst affected was HIT AND MISS who had to be checked and lost approximately one length.  Miss Rathbone was not the required distance clear of the first horse affected, GREY EBONY, when she moved in.

PENALTY SUBMISSIONS:

Mr Oatham submitted that Ms Rathbone had an excellent record with only one charge in 7 years.  He reminded the Committee that she had pleaded guilty, but still believed the offence warranted a suspension at the lower end.

Ms Rathbone submitted that she had firm engagements for Saturday 9th August.

PENALTY:

--

The Committee considered all submissions and took into account Ms Rathbone’s excellent record and her guilty plea.  However, these submissions must be balanced against the offence itself and the resultant check Mr Boylan received. 

--

Accordingly we suspend Ms Rathbone from after racing on 9th August and concluding after racing on 21st August 2008 (4 days).
