Following race 9 an Information was filed pursuant to Rule 638(1)(d).The Informant, Stipendiary Steward Mr J.Oatham alleged, that Apprentice Jockey Mr J Collett permitted his mount MAKE IT QUICK to shift inwards near the 400 metres when not sufficiently clear of CLASS ACTION (D Johnson)who was checked.

This hearing was held at the Waipa Racing Club on the 31st October 2009.



Following race 9 an Information was filed pursuant to Rule 638(1)(d).The Informant, Stipendiary Steward Mr J.Oatham alleged, that Apprentice Jockey Mr J Collett permitted his mount MAKE IT QUICK to shift inwards near the 400 metres when not sufficiently clear of CLASS ACTION (D Johnson)who was checked.

This hearing was held at the Waipa Racing Club on the 31st October 2009.

Mr J Collett  was represented by his employer, Mr R Collett and pleaded guilty to the charge.

Stipendiary Steward Mr Williamson demonstrated the video films which showed at the 400 metres J Collett was racing outside the leader when he allowed his mount to drift in when insufficiently clear, resulting in Ms Johnson mount receiving  a check. He said Mr Collett was obligated to keep his horse straight even if it is tiring.

Mr J Collett said his horse was green and running wayward but conceded he rolled inwards.

PENALTY SUBMISSIONS

Mr Coles deputizing for Mr J Oatham said Mr Collett had 4 previous breaches of this rule in the last year. He said the Committee should take into account the offending was not the worst and asked for a suspension at the bottom end.
Mr J Collett  said he had firm commitments at Te Rapa on 7.11.09 and wished to use the seven day rule. This was confirmed by his employer Mr R Collett.

Mr Coles informed the Committee that Rule 1106 covers the suspension for which will permit Mr J Collett to complete his riding commitments at Te Rapa.

PENALTY

--

The Committee carefully considered the evidence and submissions presented. We took into account the guilty plea, the interference suffered by Ms Johnson, Mr Collett’s firm riding commitments and the fact the hearing was heard at Waipa Racing Club on 31st October 2009.Rule 1106 was read and confirmed Mr Coles statement.

--

Accordingly we impose a suspension from race riding to start after racing on the 7th November 2009 and to conclude after racing on the 12th of November 2009 (4 Days).
