Decision:

Following race four an information was filed pursuant to Rule 638(1)(d).  The informant, Mr Oatham, alleged that Mr B R Jones, rider of MASTER GURU, permitted his mount to shift inwards after the start.  Mr Oatham alleged that Mr Jones was not sufficiently clear of AFFIRMATION (J McDonald) dictating that runner inwards causing interference to MR CHARLIE BROWN, ONE COOL FAMILY, GLOBAL PARTNER, AL LURCH’E and INSIGHTFUL. 



Following race four an information was filed pursuant to Rule 638(1)(d).  The informant, Mr Oatham, alleged that Mr B R Jones, rider of MASTER GURU, permitted his mount to shift inwards after the start.  Mr Oatham alleged that Mr Jones was not sufficiently clear of AFFIRMATION (J McDonald) dictating that runner inwards causing interference to MR CHARLIE BROWN, ONE COOL FAMILY, GLOBAL PARTNER, AL LURCH’E and INSIGHTFUL.

Mr Jones pleaded guilty to the charge.

Mr Coles demonstrated the video films which clearly showed Mr Jones, starting one from the outside, begin to angle his mount towards the rail.  In doing so he dictated the line of AFFIRMATION on his inside, who in turn was forced in crowding five more runners.  This resulted in MR CHARLIE BROWN (M Du Plessis) clipping heels and dipping badly.

Mr Jones said he was half a length slow at the start and allowed Mr McDonald in towards the fence.  He said Mr McDonald moved inwards before he made any contact.  Mr Jones said when contact was made he did straighten, but admitted that it was a little late.

PENALTY SUBMISSIONS:
Mr Oatham in summing up said Mr Jones continued an inward movement when only half a length clear of Mr McDonald.  This resulted in a concertina effect with Mr Du Plessis running out of room. He said Mr Jones had a good record with one suspension in the last 12 months.  He submitted a 6 – 8 day suspension was appropriate.

Mr Jones said he had commitments up until 4 November 2009.

PENALTY:
The Committee carefully considered all evidence and submissions before imposing an appropriate penalty.

In mitigation we have considered Mr Jones’ very good record, and his guilty plea.  However, these factors have to be balanced against the crowding to six runners caused by Mr Jones’ inward movement.

Normally we believe this charge would have warranted an eight day suspension.   We have reduced this to seven because of Mr Jones’ record and guilty plea.  Accordingly we impose a suspension on Mr Jones from riding in races to start after racing on 4 November, and conclude after racing on 13 November 2009 (7 days).
