Decision:
Following Race 10 Stipendary Steward Mr J C Oatham sort a ruling with regard to Rule 912(1) as to whether MIDNIGHT PRINCE ridden by C Grylls was denied a fair start.

Following Race 10 Stipendary Steward Mr J C Oatham sort a ruling with regard to Rule 912(1) as to whether MIDNIGHT PRINCE ridden by C Grylls was denied a fair start.
--Mr Oatham showed 3 video films of the start, each from a different angle. They showed the field being put in the stalls and then as the gates opened MIDNIGHT PRINCE was seen to rear up and lose considerable ground.
--Mr. Grylls said his mount became unsettled and although he did call to the starter the gates were opened and the race started.
--The official starter, Mr J Humpries, stated that his assistant, Mr D Weatherly, started the race and had unfortunately left the course before he could be informed of the inquiry. Mr Humpries did say that he had been standing behind the stalls during the start and he had not heard any calling from Mr Grylls.
--Mr L O?Sullivan, trainer of MIDNIGHT PRINCE, felt that his horse was on its hind feet only as the gates opened.
--DECISION
--After reviewing the videos and other evidence the committee could not see that any mechanical fault that could have caused MIDNIGHT PRINCE to be hindered at the start. Nor could it see any material occurrence that contributed to disadvantage the horse.
--Although MIDNIGHT PRINCE was showing some movement in the stalls it could not be regarded as serious, and in fact was no worse than some of the other starters. MIDNIGHT PRINCE may have started to rear marginally before the gates were opened. This movement could not have been expected to have been seen by the starter.
--As there were no outside influences dictating the horse's actions the committee rules that MIDNIGHT PRINCE was not denied the opportunity of a fair start.
