Decision: Following race 3 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Stipendiary Steward Mr J Oatham that Mr J Waddell, rider of STALINGRAD permitted his mount to shift inwards near the 800 metres when not sufficiently clear of TYPHOON WARNING
Following race 3 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Stipendiary Steward Mr J Oatham that Mr J Waddell, rider of STALINGRAD permitted his mount to shift inwards near the 800 metres when not sufficiently clear of TYPHOON WARNING, ridden by A Calder, who was dictated inwards, forcing HOLD THE FORT inwards, resulting in that runner clipping heels.
--Mr Waddell admitted the breach.
--Mr Oatham demonstrated the video films and showed where at the 800 metre mark and near the point of the turn, Mr Waddell moved in when not the required distance clear of TYPHOON WARNING who was forced inwards onto HOLD THE FORT, ridden by J McDonald, resulting in that runner dipping badly and almost falling. A second runner, racing behind HOLD THE FORT and slightly on the inside was also badly checked.
--PENALTY:
--Mr Oatham produced Mr Waddell’s record which showed 4 charges in the last 12 months but nothing since December. He said the Committee should take into account his guilty plea, but believed Mr Waddell was lucky a fall did not occur through his carelessness. Mr Oatham asked for 4-6 days and the offence was in the mid to high range in his opinion.
--Mr Waddell said while not blaming anyone, more experienced riders would have probably taken evasive action earlier. He asked for 4 days and a fine as there was a premier day coming up.
--DECISION:
--The Committee took into account all submissions and evidence as presented with the following being very relevant:
--1. Mr Waddell’s record.
--2. His guilty plea.
--3. His degree of carelessness and the checks to the runners inside.
--4. Mr Waddell’s upcoming engagements.
--Accordingly we impose a suspension starting after racing on 26 April and concluding after racing on 3 May 2008 (5 days).
