Following Race 2 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Mr J Oatham that near the 1000 metres LASSY SENOR (L Satherley) shifted in when not sufficiently clear causing a check to COTILLION (M Walker).

DECISION & REASON

--

Following Race 2 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Mr J Oatham that near the 1000 metres LASSY SENOR (L Satherley) shifted in when not sufficiently clear causing a check to COTILLION (M Walker). Mrs Satherley pleaded guilty to the charge.

Mr W Robinson demonstrated the video films and showed that at the 1000 metre mark Mrs Satherley riding LASSY SENOR allowed her mount to move into the line of COTILLION when only being approximately three-quarters of a length clear of that runner.

Mrs Satherley said her mount was running greenly and running erratically most of the race. She said it almost did a 'U' turn on pulling up. She added it was hanging as well.

Mr Oatham produced Mrs Satherley's record, which showed three suspensions in the last 12 months. He said this constituted a fair record. He conceded however, her mount was racing greenly, but she was not clear in moving in which did result in a sharp check to Mr Walker's mount. He believed a suspension was the appropriate penalty.

Mrs Satherley said she had been booked for OUTCAST on 9 November and was keen to retain the mount. This request was not opposed by Mr Oatham.

The Committee considered all these submissions and took into account the following:-

  3. Her guilty plea.
  4. --
  5. Her mount's greenness.
  6. --
  7. The severity of the check to Mr Walker's mount.

Accordingly, we suspend Mrs Satherley from after the conclusion of racing on 9 November 2007 and finish after the conclusion of racing on 16 November 2007 (4 days).
