Following race 2 an information was filed pursuant to rule 871(1)(d) by the informant Mr A Coles. He alleged that near the 400 metres EFINPE (Miss N Collett) was angled out when not sufficiently clear of NOCUPASORROW (N Harris) and LE GRANDE (C Parish) causing interference to both horses.

Miss Collett, who admitted the charge, was represented by her employer Mr R Collett.

Mr Williamson demonstrated the video films which showed Ms Collett angle her mount EFINPE out at the 400metre mark and in doing so take the line of NOCUPASORROW (N Harris) on her outside. She was only approximately ½ a length clear of Mr Harris when taking his line causing him to severely check his mount which in turn caused a further check to Mr Parish.

Mr Collett said he thought the fall which had just occurred prior to this incident may have been on Miss Collett’s mind causing her to lose concentration.

PENALTY:
--Mr Coles said that Miss Collett’s record was good with 2 charges since January. He said, however, that Mr Harris did receive quite a severe check.

He submitted a suspension of 4 – 5 days would be appropriate.

Mr Collett said that Miss Collett had committments up to and including Counties on 15.10.08.

--The committee considered all submissions and before imposing penalty took into account the following

1/ Miss Collett’s good record

2/ Her guilty plea
----
3/ Level of interference and the severe check received by Mr Harris.

4/ Miss Collett's engagements in the next 7 days
----
Accordingly we impose a suspension for Miss Collett to begin after racing on 15 October 08 and to conclude after racing on 22 October 2008. (5 days)
