As the charge was admitted it was found to be proved by the Judicial Committee.

Mr Danis’ Apprentice Jockey Licence was suspended from the end of racing on 12 April up to and including racing on 17 April 2017 (3 days).The days being:
13 April New Plymouth
15 April Tauranga
17 April Taupo

Facts:

Following the running of Race 9 (Te Aroha Veterinary Services 1600) Information No.A8685 was filed with the Judicial Committee. Mr Oatham alleged that Darren Danis allowed ARRAIGNMENT to shift in when not clear of HOT SAKI (L Innes) which was crowded and checked near the 250m.
 
Rule 638(1)(d) provides:  A rider shall not ride a horse in a manner which the Judicial Committee considers to be: (d) careless.
 
Mr Danis acknowledged that he understood the Rule, the charge and confirmed that he admitted the breach.
 
Mr Coles showed all film replays and identified the horses ARRAIGNMENT and HOT SAKI and where they were positioned in the approach to the 250m. Mr Coles then said that Mr Danis allowed his mount to shift in one to two horse-widths which resulted in HOT SAKI being crowded. He said Mr Danis did stop riding and straightened his mount but that it was a little too late. He added that HOT SAKI lost approximately one length.
 
Mr Harris, on behalf of Mr Danis, said that he agreed with Mr Coles. He said that he was in two minds whether Mr Danis should plead guilty to the charge, but as he (Mr Danis) had shifted in two horse-widths and that HOT SAKI had been crowded, he advised Mr Danis to admit the breach. He concluded by saying that Mr Danis needed to stop riding his mounts out when they shift and straighten them straight away.
 
Mr Danis for his part, said that he did shift in a little bit, and was a tad too late in straightening. He said that after he straightened, his horse maintained a straight line.

Submissions for Penalty:

Mr Oatham said that it was Mr Danis’ first appearance. He said that he started riding in February 2016, had had 82 raceday rides and had not had a formal warning. He said that today’s riding was beyond a warning as he had shifted in and should have corrected earlier. Mr Oatham placed the carelessness at the low-end and submitted that a suspension in the vicinity of 3-4 riding days be imposed. Mr Oatham was able to advise the Committee that Mr Danis does also ride in the Central District.
 
Mr Harris asked the committee to take into account that it was the lad’s first offence, that his horse was hard to ride and he asked for leniency.
 
Discussion then took place as to Mr Danis’ upcoming riding engagements.

Reasons for Penalty:

The committee found that near the 250m Mr Danis, who was riding his mount with the whip, allowed it to shift in approximately 2 horse-widths and near the end of the shift HOT SAKI was briefly tightened for room. Mr Danis did stop using the whip and correct his mount’s line of running, albeit a stride or two too late. The committee determined that the degree of carelessness was at the very low-end with minimal consequences. Taking all matters regarding penalty into consideration including the JCA starting point of 5 riding days suspension, the Committee determined that a 3 riding day suspension be imposed.
