As Mr Cribbin admitted the breach we find the charge proved.
Penalty:
Accordingly, ARIZONA JAZZ was disqualified from the race as per rule 647(1). We ordered Mr Cribbin forfeit his riding fee as per rule 331(2) and also imposed a $200 fine.
Charge:
Following race 7, an information was filed pursuant to Rule 647(1). The informant, Mr Neal alleged that Mr Cribbin failed to weigh in after riding ARIZONA JAZZ.
Mr Neal read the rule and Mr Cribbin acknowledged that he understood it.
Facts:
Mr Neal told the Committee that Mr Cribbin failed to weigh in after his ride on ARIZONA JAZZ.
Mr Cribbin said he basically forgot because he was used to riding overseas when normally only the first five horses are required to weigh in. He advised the Committee that it was his third ride in New Zealand and his previous two rides had finished in fifth place.
Of note ARIZONA JAZZ was unplaced in the race.

Mr Neal said Mr Cribbin had a clear record under this rule. He submitted previous penalties had attracted fines of $100 to $200. He believed there were no mitigating or aggravating factors to deviate from these penalties. Finally, he submitted ARIZONA JAZZ should be disqualified from the race.
Mr Cribben had nothing to say regarding penalty submissions.

The Committee carefully considered all the evidence and submissions presented. The mitigating factors were Mr Cribbin's admission of the breach and his clear record under this rule. The aggravating factor was Mr Cribbin failed to weigh in.
We advised Mr Cribbin he was fortunate his mount did not finish in a dividend bearing position.
The Committee referred to the Rule which confirmed ARIZONA JAZZ should be disqualified from the race. We referred to the penalty guide which recommended a starting point of $300. We verified the JCA listing of penalties which ranged from $100 to $500 fines. We noted a similar breach to Mr Cribbin attracted a $200 fine. After taking into account all the above factors we independently assess an appropriate penalty was a $200 fine.
