As Ms Farr admitted the breach the Committee find the charge proved.

Penalty:

We grant Ms Farr's request to seek a deferment to her suspension as per Rule 1106(2).

Accordingly, Ms Farr had her license to ride in races suspended for a period to commence after racing on 9 July and conclude after racing on 15 July 2016 (3 North Island days).

That period of suspension encompasses meetings at Tauranga July 13, Stratford July 14 and Avondale July 15.

Facts:

Following the running of race 6, Norwood Farm Machinery Centre 2200, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Coles, alleged that Ms Farr permitted her mount REEPERBAHN to shift outwards from near the 350 metres forcing HENRY TUDOR off its rightful line of running.

Ms Farr acknowledged that she understood the Rule and confirmed her admission of the breach. Mr R Manning assisted Ms Farr at the hearing.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Oatham demonstrated on the video films that near the 400 metres Ms Farr hit her mount with the whip. He said after that point her mount continued to gradually shift out about 4 horse widths. In doing so HENRY TUDOR was taken off its rightful running line. He noted that Ms Farr made some attempt to straighten her mount when putting her whip away. He added that Ms Farr needed to make a greater attempt not to cause interference.

Ms Farr advised the Committee that the connections of REEPERBAHN had told her the horse lugs out badly when racing on a right handed track. Ms Farr said REEPERBAHN was a very large horse and acknowledged that her effort wasn’t enough to keep her mount off HENRY TUDOR.

Mr Manning confirmed that REEPERBAHN was 17.2 hands and lugs out badly when racing this way around. He also advised his horse had just returned to racing after a long layoff due to a leg injury.

Submissions for Penalty:

Mr Coles produced Ms Farr's record which showed no previous breach under this Rule from 250 rides. He described her record as excellent and said she should be given credit for her admission of the breach. He said the level of carelessness was low end and a suspension in line with that would be appropriate.

Ms Farr advised that she had upcoming engagements at Palmerston North on 9 July, and sought a deferment to any proposed suspension. Ms Farr confirmed that she has a recent history of riding in the Central Districts on industry days.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors were Ms Farr’s admission of the breach, the level of carelessness was low end and her excellent record under this Rule for which she has been given credit. Ms Farr erred in not taking sufficient corrective action to avoid causing interference to HENRY TUDOR.

The Committee notes that Ms Farr holds a license to ride on the flat and over the jumps.

After taking into account all the above and placing emphasis on the significant mitigating factors the Committee considers an appropriate suspension was 3 days.
