Following race 4, an information was filed pursuant to Rule 632. The informant, Mr Oatham requested a ruling as to whether DONK was denied a fair start.
Submissions for Decision:
Mr Oatham demonstrated the incident by using the head on film. He pointed out to the committee that the barrier of DONK was slow to open which resulted in the horse having to force his way out.
Mr Forbes who represented the connections advised the committee that his gate was slow to open by approximately a length and a half.
Reasons for Decision:
The committee carefully considered all the evidence submitted. The video films clearly showed that DONK was denied a fair start owing to the mechanical failure of starting stalls.
