Mr Williamson lodged an information with the Judicial Committee alleging a breach of Rule 330 (3) (c) in that O Bosson failed to make weight for PHOEBE SNOW (R6) and HOT TOPIC (R10).
The charge was laid on 27th May 2015 following races at Te Aroha but the hearing was convened prior to racing today at Ellerslie (30/5/15). Mr Bosson had advised the Stipendiary Stewards that while he admitted the breach he did not wish to attend the hearing.
Mr Williamson told the committee that Mr Bosson’s racing manager rang him on the 26th May to advise that Mr Bosson was struggling with his weight for three rides the following day. One horse was scratched and he was replaced on the other two horses by Mr Matt Cameron and Mr M Coleman.
Decision:
As Mr Bosson admitted the breach the charge was found to be proved.
Submissions for Penalty
Mr Williamson said Mr Bosson’s record under this rule highlighted a history of weight problems. He has been dealt with under the minor infringement scheme many times with the most recent being on the 20th May this year when he was fined $200 for a second offence within 120 days. Mr Bosson told Mr Williamson that he would be taking a little time out from riding and did not wish to make any submissions in regard to penalty.
The Stewards’ submitted that in light of Mr Bosson having a break from riding a monetary penalty was more appropriate that a suspension. Mr Williamson said the affected trainers had found senior riders as replacements and had not really been let down by losing the services of Mr Bosson. His submission was for a fine of not less than $300.
Reasons for Penalty:
Mr Bosson’s record shows three breaches of the overweight rule this year and on each occasion he has been fined the sum of $200. We agree, in light of Mr Bosson’s decision to take some time out from riding, that a suspension would be inappropriate. Considering all of the submissions we adopted a starting point of $500. Mitigating factors are Mr Bosson’s early notification to the Stewards and the fact that both replacement riders were experienced jockeys. Although Mr Bosson is a highly regarded and talented rider the connections of the horses and the betting public would not have been let down by the services of Mr Coleman and Mr Cameron.
Penalty
Taking into account all of the submissions we fined Mr Bosson the sum of $400.00.
