Decision:

We accordingly dismiss the charge against Miss Collett.

Facts:

Following the running of race 1, Te Aroha Veterinary Services 2200, an Information was filed pursuant to Rule 636(1)(d). The Informant, Mr Williamson alleged that Miss Collett relaxed her ride near the 75 metres when there was a reasonable chance of ABSOLUTE GEM finishing 3rd.

Miss Collett acknowledged that she understood the nature of the charge, the Rule and confirmed she denied the breach.

Rule 636(1) (d) provides:

that being the rider of a horse in a race must ride his or her horse out to the end of the race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared.

The Rule was read aloud to Miss Collett.

Submissions for Decision:

Mr Robinson demonstrated on the head – on film that in the final straight Miss Collett was riding her mount with vigour. He said it was clear near the 75 metres Miss Collett relaxed her ride. He said the film shows Miss Collett stood up in the saddle for approximately 3 strides before she goes for her horse again. He advised the Committee Miss Collett’s mount was officially placed 4th a head away from 3rd position.

Mr Robinson said the Stewards believe Miss Collett relaxed her ride because she thought her mount was going to finish in 3rd place. He added the Stewards were of the view ABSOLUTE GEM had a reasonable chance of finishing in 3rd place.

Miss Collett submitted ABSOLUTE GEM was a relatively hard ride and was well tried with the whip. Miss Collett said she felt her mount dip and falter for 2 strides near the 75 metres which resulted in her having to pull ABSOLUTE GEM head up. This led Miss Collett to believe her mount may have gone amiss. However, she felt ABSOLUTE GEM'S action improve again on his 3rd stride and continued to ride him out to the end of the race. She added that ABSOLUTE GEM may have hit a hole in the track and her fellow riders had commented on the roughness of the track.

Mr Williamson did not wish to cross examine Miss Collett.

In response to questions from the Committee, Mr Williamson stated he cannot dispute Miss Collett’s submission that her mount dipped for 2 strides near the 75 metres. Mr Williamson said the Stewards did not inspect the track near the alleged incident to determine if there was a hole in the track. Mr Williamson acknowledged the track was rough and patchy after being raced on 6 days ago.

In summing up Mr Williamson stated the evidence of Mr Robinson was quite clear that Miss Collett did relax her ride near the 75 metres. He noted Miss Collett admitted she relaxed her ride but there were reasons why she did. He said the Stewards believe there was a reasonable chance ABSOLUTE GEM may have finished in a better position without taking into account the horse dipped.

Miss Collett in summing up submitted the way she reacted to ABSOLUTE GEM'S galloping action was natural and believed any rider would have made the same response. She said when she relaxed her mount for 2 strides it was in the interest of ABSOLUTE GEM’S welfare after he faltered on 2 occasions. Miss Collett reiterated on the horse's 3rd stride she went back to riding him forward to the end of the race.

Mr Williamson confirmed ABSOLUTE GEM was vet checked post-race which showed no abnormalities.

Reasons for Decision:

The Committee carefully considered all the submissions presented and reviewed the available video film frame by frame several times. The head–on was the only film available to assist the Committee. The side–on film from the inside of the track was of little help because it was a distant shot. The normal side–on film did not show the incident due to the distance between the placed horses.

Prior to the alleged incident it was noticeable that FEAR OF GOD which finished 3rd was taking ground off ABSOLUTE GEM who was being ridden with vigour. The Committee accepts that Miss Collett did relax her ride near the 75 metres for approximately 2 strides. However, we note that Mr Williamson did not dispute Miss Collett's submissions that her mount dipped and faltered for 2 strides near the 75 metres. We accept the submissions of Miss Collett that ABSOLUTE GEM dipped for 2 strides. The head– on film shows ABSOLUTE GEM'S galloping action altered near the 75 metres with his head dipping on 2 occasions. Under these particular circumstances we are satisfied Miss Collett may have been entitled to believe her mount had gone amiss. When ABSOLUTE GEM regained its normal action after 3 strides Miss Collett commenced to draw the whip again and ride her mount out to the end of the race.

We do not believe that the charge has been proved to the required standard.
