Accordingly, after taking all the above into account we are satisfied that GOOSEBUMPS would not have beaten STAGEHAND if the slight inward movement had not occurred. Therefore the protest is dismissed and the judges placings shall stand.
The committee orders the payment of stakes and dividends accordingly.
Facts:
Following race 6, the Maramarua Hunt & Kate Smyth House of Travel Open Steeplechase, a protest was lodged pursuant to rule 642(1).
The informant alleged that STAGEHAND, placed first by the judge, interferred with the chances of GOOSEBUMPS, placed second by the judge. This interference is alleged to have occurred in the final straight.
The judges placings were as follows:
No 7 STAGEHAND - 1st
No 5 GOOSEBUMPS - 2nd
No 1 JACK ROMANOV - 3rd
The margin between first and second was a long head.
Rule 642 (1) reads: if a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the judicial committee is of the opinion that the horse so interferred with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediatly after the horse interferred with.

Miss Farr demonstrated the video films pointing out where, in her opinion, STAGEHAND has moved in taking her rightful line of running. She said this caused her to stand up in the irons and take 3 pulls on her reins, which caused her to misjudge the fence. Miss Farr said this resulted in her losing momentum and losing approximately 1 length before she recovered to be within a long head at the line.
Mr Brooks said he agreed with the evidence of Miss Farr, saying that STAGEHAND has laid in and hampered GOOSEBUMPS. He said it had cost his horse 1 length and noted that he recovered to finish within a long head at the post.
Mr Mitchell said in his opinion it was competitive riding and there was no contact between the 2 horses. He admitted his whip may have made contact with GOOSEBUMPS but Miss Farr had plenty of room to jump the fence and could have won the race if it had been good enough.
Mr S Clotworthy pointed out to the hearing where Miss Farr had also sat up approaching the second to last fence just as she did at the last fence. He said GOOSEBUMPS had also drifted out towards STAGEHAND coming to the fence but the horses never touched. Mr Clotworthy concluded by saying Miss Farr had ample time to run STAGEHAND down if it had been good enough.
Mr Oatham said STAGEHAND had come from behind GOOSEBUMPS before approaching the last fence. He conceded that STAGEHAND does lay in slightly in the approach to the last fence but held a clear advantage over GOOSEBUMPS once the 2 horses had jumped the last fence and held that advantage to the post.
Accordingly he said the stewards did not support the protest.

The committee has carefully considered all the evidence and submissions as presented and reviewed the video films. While the films show that STAGEHAND does move in slightly in the approach to the last fence the committee is satisfied that there was still sufficient room for GOOSEBUMPS to jump the fence safely. It is also relevant that STAGEHAND came from behind GOOSEBUMPS approaching the last fence and maintained that advantage in the run to the line.
