Following Race 6 an Information was filed pursuant to rule 638 (1) (d).  The Informant Mr Williamson alleged that Miss Collett permitted her mount OSCAR TIME to shift inwards near the 200 metres dictating SWAP FOR KASH (T Thornton) inwards causing a check to AGENDA (M Wenn).

FACTS:

--

Mr Oatham demonstrated the video films and pointed out to the Committee Miss N Collett, rider of the winner OSCAR TIME, racing well out on the track soon after turning for home.  It was then evident that Miss Collett, who was riding her mount vigorously, began an inward movement dictating the line of SWAP FOR CASH who was on her inside.  This inward movement caused Miss Thornton, rider of SWAP FOR CASH, to move in also and into the line of AGENDA which had to be checked.  Mr Oatham said that Miss Collett did straighten her mount initially but then continued to ride with the whip causing Mrs Thornton to move in to avoid the heels of OSCAR TIME.  Mr Oatham said the inward movement of Miss Collett was not great but she was clearly not the required distance clear of Mrs Thornton when she did move in.

Miss Collett had no submissions to make.

SUBMISSION(s) ON PENALTY:

Mr Williamson said Miss Collett had incurred only one charge in the last twelve months which was an excellent record for the number of rides she has.  He submitted her carelessness was on this occasion at the low end.

Miss Collett said she had commitments up to and including Ruakaka on August 25 2010.

REASON(s):

--

The Committee considered all evidence and submissions before imposing an appropriate penalty.  Mitigating factors are Miss Collett’s guilty plea and her excellent record.  However these factors must be balanced against the interference caused by Miss Collett.  The committee believes that although Miss Collett was not the required distance clear of Miss Thornton when moving in the interference to AGENDA was made worse by Mrs Thornton’s mount over reacting to the inward movement of Miss Collett.  Therefore we consider Miss Collett’s carelessness was at the low end.

Accordingly after taking all the above factors into account we impose a suspension on Miss Collett from riding in races which is to start after racing on 25 August and conclude after racing on 1 September 2010 (4 days).
