Decision:

Accordingly the protest is dismissed and the Judge's placings shall stand. In conclusion we order the payment of stakes and dividends.

Facts:

Following the running of Race 7, Norwood Farm Machinery Centre Morrinsville 1200, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mrs Herbert, alleged that LOUEY VELOCE placed 1st by the Judge interfered with the chances of APACHEE TAAT placed 2nd by the Judge.

The interference was alleged to have occurred in the final straight.

The Judge's placing were as follows:

1st No. 3 LOUEY VELOCE
2nd No. 4 APACHEE TAAT
3rd No. 14 THE BAMPOT
4th No. 5 VARRO

The official margin between 1st and 2nd was half a length.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

All connections present acknowledged they understood the Rule.

Submissions for Decision:

Miss Holmquist submitted that coming around the turn LOUEY VELOCE pushed her mount out and made contact which resulted in APACHEE TAAT losing momentum. She was of the opinion the incident cost her mount more than the half a length margin at the finish.

Mrs Herbert said that she agreed with her rider’s submission and added LOUEY VELOCE clearly hampered APACHEE TAAT in the final straight.

Mr Tiley submitted “why are we in here?” He said horses shift wide on winter tracks and LOUEY VELOCE was going away from APACHEE TAAT on the finish line.

Miss Smyth submitted her mount was always travelling better and over the final stages of the race APAHEE TAAT was running in on her. She added LOUEY VELOCE won the race easily.

Mr Oatham on behalf of the Stewards submitted the protest had very little merit. He said there was slight interference on the turn but both horses had their opportunity to win the race. He said in the final 4 strides APACHEE TAAT was shifting in onto LOUEY VELOCE. In conclusion he submitted the protest should be dismissed.

Both Mrs Herbert and Mr Tiley when given the opportunity to sum up had nothing further to add.

Reasons for Decision:

The Committee carefully considered all evidence and submissions presented and reviewed the video films several times. The head-on film showed near the 450 metres LOUEY VELOCE did shift out for several strides, however this did not have any impact on APACHEE TAAT's momentum. The films showed that after that point both horses had an equal opportunity to win the race with no interference occurring. At approximately the 200 metres APACHEE TAAT went past LOUEY VELOCE but at the finish LOUEY VELOCE was comfortably going away from APACHEE TAAT.

In summary the Committee is not satisfied any relevant interference occurred and the protest was bordering on being frivolous.
