Facts:

Following the running of Race 4, Ms Riley, trainer of the second placed horse TSAR BOMBA, lodged a protest pursuant to Rule 642(1). She alleged that CRUSH THE CASTLE, placed first by the judge, caused interference to TSAR BOMBA in the final 200 metres.
The judge’s placings were as follows:
1st no.3 - CRUSH THE CASTLE
2nd no.2 - TSAR BOMBA
3rd no. 11 - SAMER WAY
4th no.19 - CAPISTRANO GOLD
The official margin between 1st and 2nd was half a long neck.

Submissions for Decision:

Ms Riley demonstrated the alleged incident using all the available video films. She said her horse was running on solidly in the run up the straight and was just winding up when CRUSH THE CASTLE moved out into TSAR BOMBA’S running line. She said her horse was a big heavy horse and he clearly lost momentum when Mr Nolan had to check and go for a run on the inside of CRUSH THE CASTLE. She said the video films clearly showed her horse was coming back and making ground in the run to the finish line.
Mr Nolan said he was sitting behind CRUSH THE CASTLE when he started to move out. This resulted in him having to check off the heels of CRUSH THE CASTLE. He believed this cost him a length to a length and a half stating that he had no doubt he would have won the race if interference had not occurred.
Mr Innes said it was CRUSH THE CASTLE’S first start and the track was very hard. He admitted that he initially came out abruptly but believed he was a length and a half clear. He said he then straightened up before his mount ducked out again. He then eased up on his mount and was very doubtful that TSAR BOMBA would have beaten CRUSH THE CASTLE.
Mr Larsen believed when viewing the films Mr Nolan only stopped riding for one to one and a half strides, he also believed Mr Innes had to stop riding to straighten up his mount.
Mr Williamson when asked for his assessment submitted that there was no doubt that interference had occurred but the committee had to be sure TSAR BOMBA would have beaten CRUSH THE CASTLE if interference had not occurred.
Ms Riley when given the opportunity to sum up said the interference had cost TSAR BOMBA momentum and it was making ground on CRUSH THE CASTLE at the finish.

Reasons for Decision:

The committee carefully considered all evidence and submissions presented and reviewed the video films on several occasions. We established that at the 200 metres CRUSH THE CASTLE shifts out into the running line of TSAR BOMBA when approximately one and a half length’s clear. It was clearly evident on the films that shortly following this CRUSH THE CASTLE moved out quite abruptly when insufficiently clear causing TSAR BOMBA’s rider, Mr Nolan to check off its heels and lose momentum in doing so. It is also very significant that CRUSH THE CASTLE was leading on the rails entering the straight and ended up at least 6 horse widths out at the 150 metres dictating the line of TSAR BOMBA. The films confirmed that TSAR BOMBA was finishing the race off strongly coming from a position of one and a half lengths behind CRUSH THE CASTLE at the 150 metres to get within a long neck at the finish.
For these reasons we are satisfied that TSAR BOMBA would have beaten CRUSH THE CASTLE had interference not occurred.
