Accordingly for the above reasons the protest is dismissed and the judge’s placings shall stand.

It was ordered the dividends and stakes be paid in accordance with the decision.

Facts:

Following the running of race 4 an information was lodged pursuant to Rule 642(1).The informant Mr C Ormsby alleged that HEZA KARMA KARZI or its rider placed 1st by the judge caused interference to BELLA RENZA placed 4th by the judge. The alleged interference occurred in the final straight.

Submissions for Decision:

Mr Ormsby demonstrated the video films and pointed out to the committee at the 300 metres he had to check his mount when attempting to rail up inside HEZA KARMA KARZI. He believed his mount was interfered with for 5 strides which cost him 2 lengths as HEZA KARMA KARZI rolled back to the rails.

Mr Johnson said he believed there was a clear margin for BELLA RENZA to improve up the inside of HEZA KARMA KARZI. He said BELLA RENZA was ¾ up inside the flank of HEZA KARMA KARZI when Mr Ormsby had to check his mount costing him 2 lengths.

Mr Molloy demonstrated on the video films that HEZA KARMA KARZI had rolled off the rail for 8 strides and at no stage was there a clear run available for BELLA RENZA on his inside. He said Mr Ormsby had made an error of judgment in attempting a run on the inside of HEZA KARMA KARZI.

Mr Walker said HEZA KARMA KARZI had come off the rail a fraction on the turn but never believed a gap was presented for BELLA RENZA.

Mr Cooksley said he rolled out slightly on the turn and believed Mr Ormsby made an error by going for an inside run that was not available.

Mr Oatham, Stipendiary Steward, when asked for his submissions said he struggled to see there was a clear run available for BELLA RENZA and could not support a change of placings.
Mr Ormsby when asked to sum up had nothing new to add from his earlier evidence.

Reasons for Decision:

The committee carefully considered all evidence and submissions as presented. It was clear on the video films that BELLA RENZA did receive a check when attempting a run on the inside of HEZA KARMA KARZI at the 300 metre mark. However it was clearly evident on the head on films the reason Mr Ormsby had to check his mount and lose momentum was because there was never a gap large enough to allow a horse on the inside of HEZA KARMA KARZI. Therefore we are not satisfied that HEZA KARMA KARZI caused interference to BELLA RENZA.
