Accordingly, Ms Wenn had her license to ride in races suspended for a period to commence after racing on 31 July and conclude after racing on 23 August 2019.
The race meetings at Hawera on 1 August and Te Rapa on 2 August were not included in the penalty because the declaration of riders had closed.
Facts:
Following the running of race 1, Gartshore 1600, an Information was filed pursuant to Rule 636(1)(d). The Informant, Mr Jones, alleged that Ms Wenn failed to ride SHAHANA out to the end of the race when there was a reasonable chance of finishing in 3rd position.
Ms Wenn acknowledged that she understood the Rule and confirmed her admission of the breach.
Rule 636(1) (d) provides: A person being the rider of a horse in a race must ride his or her horse out to the end of the race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared.
Mr Williamson demonstrated the incident using the available video footage. He identified that Ms Wenn relaxed her ride for a good 3 strides before the finish line. He demonstrated that with a 100 metres to run EACH WAY was 3 to 4 lengths in arrears of SHAHANA yet that runner finished in 3rd place. The Stewards stated that they were not certain that SHAHANA would have finished in 3rd placing but there was a reasonable chance.
Ms Wenn said that she was wearing dark googles and misjudged where the finish line was. She added that SHAHANA pulled its head up near the 50 metres because her mount was struggling in the heavy track conditions.
Submissions for Penalty:
Mr Jones said that Ms Wenn had a clear record under this Rule from 5 race day rides in the last 12 months and to her credit she admitted the breach. He referred to the JCA Penalty Guide which provides a starting point of a 3 weeks suspension.
Ms Wenn advised that she had no commitments in the next 7 days and any proposed suspension could start immediately.

The Committee considered all the evidence and submissions presented.
The Penalty Guide for Judicial Committees has a sliding scale for breaches of this Rule. The starting point relates to the potential placing deemed to have been lost as a result of the breach. A rider potentially missing out on 3rd place faces a starting point of 3 weeks suspension which was adopted in this case.
The Committee reviewed the video footage of the incident. We observed that Ms Wenn clearly relaxed her ride over the concluding stages of the race when racing in 3rd place. Ms Wenn has an obligation under the Rules to ride her mount out to the end of the race and she must leave no doubt to the outcome of the race. It is a well-known fact in the Racing Industry that when a horse has been ridden out and fully extended, and then it ceases to be ridden out, it will relax rather quickly and shorten stride especially in the heavy track conditions that existed today. We are satisfied this breach was an error of judgement and there was no intent on Ms Wenn’s part.
The mitigating factors were Ms Wenn’s admission of the breach and her clear record under this Rule from limited opportunities. For these combined factors Ms Wenn was afforded a 1 day reduction in penalty.
