As the charge was admitted and all four horses required replacement riders the charge was proved.

Mr Elliot’s Jockey’s License was suspended from the end of racing on 4 October through to the close of racing on 14 October 2020 (5 days).
In determining penalty the admission of the breach was taken into consideration.
Facts:
Prior to the running of Race 1, Information No. A12944 was filed with the Judicial Committee. It was alleged by the Informant that Mr Elliot could not make the contracted weight for SLINKLY LINKY, SHAKE THAT TUSH, MARBUZET and OUR WONDERLAND.
Mr Elliot said that he understood the Rule and confirmed that he admitted the breach.
Mr Jones said that Mr Elliot was approximately 1kg over the carded weight.
Mr Elliot said that he was overweight and was having a lot of trouble reducing his weight, especially since Covid-19 and breaking his collarbone.
Submissions for Penalty:
Mr Jones said that Mr Elliot has a poor record in that this breach was his fourth in the last 120 days. He recommended that a fine be imposed as a suspension would not help Mr Elliot with his weight problems.
Mr Elliot said that he would prefer a suspension as it would give him time to sort out his weight problems. He added that a suspension could start after racing on 4 October 2020.

The Committee gave careful consideration to the penalty submissions which included Mr Elliot’s poor record under Rule 330(3)(c) of the NZ Thoroughbred Rules of Racing. The Committee determined that a term of suspension was a condign sanction to impose.
Mr Elliot must not continue to be overweight for his contracted riding engagements. This practice on a raceday, forces connections to find replacement riders at late notice and also affects punters, whom at times would not be aware that Mr Elliot had been replaced.
Albeit one Information only was filed, he was overweight for four horses.
The penalty imposed must be of such sufficiency that it is a deterrent to all riders, as well as being a suitable penalty for the Respondent’s breach.
