As the charge was admitted it was found to be proved.

Penalty:

Mr Nason was fined $300.

Facts:

Following the running of Race 9 (J Swap Contractors 2100) Information No.A8536 was filed with the Judicial Committee. It alleged that Mr Jordan Nason used the whip excessively on the horse SLICE OF CAKE.

Rule 638(3)(b)(ii) provides:

A rider shall not: (b) strike a horse with the whip in a manner or to an extent which

is: (ii) Excessive

Mr Coles showed all film replays and said that Mr Nason hit his horse 11 to 12 times prior to the 200m and gave a break only every 3 strides and was clearly outside the guidelines of 6-on 6-off.

Mr Harris, for Mr Nason, said that he agreed with Mr Coles' interpretation and added that he had been working with Mr Nason regarding his whip use and was trying to get him to slow down and adapt to the New Zealand style of using the whip. He said that the whip was not applied with undue force.

Mr Nason said that coming from England and being used to their style of riding, he was having a little trouble adapting to the New Zealand style. He apologized and said that it will not happen again. He advised the Committee that he had had 30 raceday rides in New Zealand.

Submissions for Penalty:

Mr Williamson said that Mr Nason had a clear record, had admitted the breach and that the Stipendiary Stewards considered it to be at the low-end of the scale.

Mr Harris agreed with Mr Williamson’s submission and reiterated that Mr Nason has to slow down with the whip.

Mr Nason did not comment regarding penalty.

Reasons for Penalty:

After taking into account the penalty submissions, the JCA starting point and all other matters relating to penalty, the Committee made the following determination;

A fine in accordance with the relatively low breach of the Rule be imposed.
