As Mr Norvall admitted the breach the Committee find the charge proved.

Penalty:

Accordingly, Mr Norvall had his license to ride in races suspended for a period to commence after racing on 27 June and conclude after racing on 2 July 2015 (3 North Island days).

Facts:

Following the running of race 7, Quadrant Pacific 1600, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that near the 1400 metres Mr Norvall allowed his mount LITTLE ALFIE BROWN to shift in when not sufficiently clear of DOIKNOWYOU (M McNab) which clipped a heel and blundered.

Mr Norvall acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Williamson identified on the video footage that Mr Norvall allowed his mount to shift inwards approaching the 1400 metres when being restrained into the running line of DOIKNOWYOU which clipped a heel and blundered. He said Mr Norvall was just over 1 length clear when shifting inwards.

Mr Norvall told the Committee that the films were self-explanatory and had nothing to add.

Submissions for Penalty:

Mr Oatham produced Mr Norvall’s record which showed no previous breach under this Rule in the last 12 months. He said this is a very good record and Mr Norvall should be given credit for his early admission of the breach. He said Mr Norvall misjudged the shift in and it was unfortunate DOIKNOWYOU clipped a heel and blundered. Mr Oatham said the level of carelessness is low end and submitted a suspension at the bottom end would be appropriate.

Mr Norvall advised that he had upcoming engagements at Ruakaka on 27 June, and sought a deferment to any proposed suspension. He informed the Committee that he has recently been riding in the Central Districts and asked us to take that into account when considering penalty.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The notable mitigating factors are Mr Norvall’s admission of the breach, the level of carelessness is low end and his excellent record in relation to this Rule.

The Committee is satisfied that Mr Norvall has a recent history of riding in the Central Districts on Industry days.

After taking into account all the above factors the Committee considers an appropriate suspension is 3 days.
