As Ms Holmquist admitted the breach the Committee find the charge proved.

Penalty:

Accordingly, Ms Holmquist had her license to ride in races suspended for a period to commence after racing on 24 June and conclude after racing on 8 July 2015 (7 North Island days).

The Committee has not included 5 July race meeting at Te Aroha as this is scheduled for Highweight and Jump riders only.

Facts:

Following the running of race 6, GPS – it Precision Land Mapping 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that near the 300 metres Ms Holmquist allowed her mount YSABELLA BRAVE to shift out when not sufficiently clear of SPOKE TO CARLO (D Johnson) which was hampered for a distance and checked.

Ms Holmquist acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach. Mr Harris supported Ms Holmquist at the hearing.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Williamson demonstrated on the video footage that YSABELLA BRAVE was racing on the inside of SPOKE TO CARLO rounding the home turn. He identified that near the 300 metres Ms Holmquist allowed her mount to shift out when not sufficiently clear and she continued to interfere with SPOKE TO CARLO for at least 150 metres. Using the head – on film Mr Williamson indicated that YSABELLA BRAVE shifted out at least 10 horse widths. He said Ms Johnson had to take hold of her mount near the 150 metres and shift ground to the inside of YSABELLA BRAVE. He said SPOKE TO CARLO then finished the race off very strongly to finish in 2nd place and believed it would have won the race if no such interference had occurred.

Ms Holmquist told the Committee that she shifted out in search of better ground and was not aware that Ms Johnson was racing on her outer.

Mr Harris advised that Ms Holmquist needs to be more aware of the horses around her.

Submissions for Penalty:

Mr Oatham produced Ms Holmquist record which showed 3 previous breaches under this Rule in the last 12 months. He said her record was no better than average, the level of carelessness was described at the high end of scale due to the interference occurring for such a length of time (150 to 200 metres). He said had the interference not occurred SPOKE TO CARLO would have won the race. Mr Oatham submitted an appropriate suspension would be in the 6 to 8 day range.

Ms Holmquist advised that she had upcoming engagements at Matamata on 24 June, and sought a deferment to any proposed suspension. Ms Holmquist informed the Committee that she has recently ridden in the Central Districts which was confirmed by the Stewards. She asked the Committee to take into account the fact she had not breach this Rule for several months.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The only mitigating fact is Ms Holmquist’s admission of the breach. We consider her record (4th breach in 12 months) to be average for an Apprentice rider and a neutral factor. The aggravating factors are Ms Holmquist had a duty of care to ensure that she was the required distance clear before attempting to shift out. The interference went on for approximately 150 metres with Ms Holmquist significantly impeding the progress of SPOKE TO CARLO. The films clearly show that YSABELLA BRAVE cost SPOKE TO CARLO the opportunity to win the race as the interference lasted for a sustained period. An additional aggravating fact is Ms Holmquist failed to take any corrective action while continuing to ride her mount forward when it was clearly apparent her mount was shifting out. This resulted in SPOKE TO CARLO being forced over extra ground and we assess this movement to be about 10 horse widths. Ms Johnson was forced to check SPOKE TO CARLO near the 150 metres to avoid the heels of YSABELLA BRAVE. The Committee assess the level of carelessness to be mid – range but the consequences of Ms Holmquist's actions are in the high range. The Committee find it hard to believe that Ms Holmquist was not aware that SPOKE TO CARLO was racing on her outside because the films show that Ms Holmquist looked to her outside on 2 occasions early in the home straight when shifting out.

The Committee is satisfied that Ms Holmquist has a recent history of riding in the Central Districts.

After taking into account all the above factors the Committee considers an appropriate suspension is 7 days.
