As the breach was admitted we find the charge proved.

Penalty:

Accordingly after taking all the above into account and under the provisions of rule 1106 (2) we impose a suspension of Mr Grylls' riding license which is to start after racing on 9 November and conclude after racing on 15 November 2012 (5 days).

Facts:

Following race 1 an information was filed pursuant to rule 638 (1) (d).  Mr Oatham alleged that Mr C Grylls permitted his mount JERSEY GIRL to shift outwards near the 200 metres when insufficiently clear causing interference to the following horses:  SNIPPECHEE, PINS GIFT, VENDEMIARE and SCHRODINGERS CAT. 

Submissions for Decision:

Mr Robinson demonstrated the video films and pointed out JERSEY GIRL moving out into the line of SNIPPECHEE at the 200 metre mark.  He said Mr Grylls moved out 2 horse widths but conceded he did stop riding and straighten albeit a stride too late.  He submitted that Mr Grylls was not the required distance clear when moving out.

Mr Grylls in admitting the breach said his mount ducked out suddenly and he tried to straighten but admitted he may have been a stride too late in doing so.

Submissions for Penalty:

Mr Oatham submitted that Mr Grylls should be given credit for his admission of the breach, his full cooperation with the stewards and his outstanding record.  He said Mr Grylls had a clear record in the preceding 12 months.  Mr Oatham told the committee that the consequences of Mr Grylls' action were not fairly reflected in the degree of carelessness he displayed.  He submitted this breach was at the low end but the aggravating factor was the severe interference suffered by several horses as a result of the chain reaction caused initially by Mr Grylls.

Mr Grylls confirmed he had committments up to and including 9 November and he only rode as far south as Christchurch.

Reasons for Penalty:

The committee carefully considered all evidence and submissions.  Mitigating factors are Mr Grylls' admission of the breach and his outstanding record.  These must be considered alongside the aggravating factor of the severe interference suffered by several horses as a result of Mr Grylls moving out when insufficiently clear.  However because Mr Grylls only moved out 2 horse widths and did take corrective action we find his carelessness to be in the low to mid range.  Normally when a relegation occurs and several horses are affected the standard penalty would be 6 - 7 days.  In this instance and in consideration of Mr Grylls' excellent record we find an appropriate penalty to be one of 5 days.
