Accordingly after taking all the above into account we uphold the protest. Therefore SNIPPECHEE is promoted to first. Before considering the final result however the committee must refer to the second protest under information no. 4856.
Facts:
Following race 1 a protest was lodged pursuant to rule 642. The informant Mrs T Thornton alleged that the winner JERSEY GIRL interferred with the chances of her mount, SNIPPECHEE, placed second by the judge. She alleged this interference occurred in the final straight.
The Judges' placings were:
14 JERSEY GIRL 1st
2 SNIPPECHEE 2nd
3 SCHRODINGERS CAT 3rd
6 PINS GIFT 4th
4 TWELVE KINGDOMS 5th
The official margins were a nose between first and second, 1 1/4 lengths between second and third and a neck between third and fourth.
Submissions for Decision:
The informant Mrs Thornton demonstrated the video films pointing out the outward movement of JERSEY GIRL who shifted into the line of running SNIPPECHEE was entitled to. Mrs Thornton claimed the interference cost her one length and given the official margin of a nose between first and second she considered her mount was a certainty beaten.
Mr Walker said JERSEY GIRL had shifted out 2 horse widths taking the line of SNIPPECHEE which caused a chain reaction resulting in interference to the outside horses.
Mr Grylls, rider of JERSEY GIRL, admitted he did move out under pressure and hamper SNIPPECHEE. However SNIPPECHEE had headed him but his horse fought back and he believed Mrs Thornton had every chance to beat him.
Mrs Hillis confirmed the evidence of Mr Grylls.
Mr Oatham, when asked for his assessment of the incident, said it was evident that JERSEY GIRL had moved out when a bare length clear. He said this caused severe interference to several horses and submitted the protest should be upheld.
Mrs Thornton in summing up, told the committee she was not responsible for contributing to the interference received by SCHRODINGER'S CAT and PINS GIFT.
Reasons for Decision:
The committee carefully considered all evidence and reviewed the video films. It was clearly evident that JERSEY GIRL had taken the line of SNIPPECHEE when not the required distance clear. The check to Mrs Thornton was a sharp one and after taking into account the nose margin at the post the Committee is satisfied that if interference had not occurred SNIPPECHEE would have beaten JERSEY GIRL.
