Facts:
Following Race 1 an information was filed pursuant to rule 642. The informants, Mr Du Plessis and Mr Innes, alleged that JERSEY GIRL and SNIPPECHEE, placed first and second by the judges interferred with the chances of their mounts SCHRODINGERS CAT and PINS GIFT who were placed third and fourth by the judge. They alleged this interference occurred in the final straight.
The judges' placings were:
14 JERSEY GIRL 1st
2 SNIPPECHEE 2nd
3 SCHRODINGERS CAT 3rd
6 PINS GIFT 4th
4 TWELVE KINGDOMS 5th
The official margins were a nose between first and second, 1 1/4 lengths between second and third and a neck between third and fourth.
Submissions for Decision:
Mr Innes told the hearing that he was just winding up when he received interference from the 2 runners on his inside which effectively stopped his chances of winning the race which he submitted he thought he was going to do.
Mr Pike confirmed the evidence of Mr Innes saying the interference cost his horse a winning chance.
Mr Du Plessis, rider of SCHRODINGERS CAT, said as he was on the outside he suffered the worst of the interference. This resulted in him in losing all chance of winning at a vital stage of the race when he was making his run.
Mr Autridge said it was clearly evident the interference to his horse was severe and certainly extinguished the possible winning chances of both horses.
Mr Oatham, when asked for his assessment of the incident, said the outward movement of JERSEY GIRL resulted in both PINS GIFT and SCHRODINGERS CAT receiving severe interference. He said he could not support the protest against the second horse SNIPPECHEE as the interference was beyond Mrs Thornton's control.
Reasons for Decision:
The committee considered all evidence and reviewed the video films. It was clearly evident that SCHRODINGERS CAT and PINS GIFT did receive severe interference from the outward movement of the two inside horses. However the committee is satisfied that SNIPPECHEE was in no way responsible as its line was being dictated by JERSEY GIRL. Therefore the protest against SNIPPECHEE is dismissed.
The committee must now consider the severity of the interference received by SCHRODINGERS CAT and PINS GIFT, the strong manner in which they were finishing the race at the time and the evidence given by both riders. We find both these horses lost more than the 1 1/4 length and neck margins which they were beaten by at the post.
Therefore we are satisfied that if interference had not occurred to SCHRODINGERS CAT and PINS GIFT they would have finished in front of JERSEY GIRL.
