Penalty:

This Committee suspends Mr Weatherley's Riders Licence from after the conclusion of Racing on the 4th of January 2018 until after the conclusion of Racing on the 12th of January 2018 (6 National Riding days).

Facts:

Following the running of the TASTE OF ASIA MOUNT MAUNGANUI 2100, an Information was lodged by Senior Stipendiary Steward, Mr M Williamson against Class B Rider, Mr S Weatherley alleging that Mr Weatherley as the rider of ANARCHY angled his mount outwards approaching the 200 metres mark when not sufficiently clear of AMELIA which was checked.

Rule 638(1)(d) provides : A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Weatherley was present at the hearing and he confirmed to the Committee that he understood the Rule and that he admitted the breach.

Mr Weatherley was assisted by Mr A Scott one of his co-employers.

Chief Stipendiary Steward, Mr J Oatham demonstrated the incident by use of the race films. He showed where ANARCHY was 3 back on the fence approaching the 200 metres and was angled outwards sharply by Mr Weatherley and moved out approximately 4 horse widths into the line of AMELIA (Rider, J Nason) which was checked. He said that Mr Weatherley was not sufficiently clear of AMELIA and Mr Nason had to take hold of his horse.

Mr Weatherley said that he had made an error of judgement. He said he thought he had was clear and that the move was more abrupt than he expected. He said he took evasive action but it was too late.

Submissions for Penalty:

Mr Williamson said that Mr Weatherley had a good record under this Rule and in the last 12 months he had one breach on the 1st of April 2017 for which he received a 5 day suspension.

He said Mr Weatherley's actions constituted mid range carelessness but that the interference was low level.  He said that Mr Weatherley had co-operated with the Stewards and had admitted the breach at the first instance.

Mr Weatherley did not make submissions as to penalty but asked for a deferment of his suspension until after the Thames Jockey Club meeting on the 4th of January 2018.

Reasons for Penalty:

The Committee reviwed the films and the evidence. The incident is clearly shown on the films and it showed the abrupt movement by Mr Weatherley. There was a clear passage until he came close to Mr Nason's horse and he was not sufficiently clear of that horse and Mr Nason had to check it. Mr Nason had to take hold for 2 to 3 strides but in our view his chances were not greatly affected.

We believe that the totality of the carelessness is in the low to midrange and for that we have adopted a starting point of 7 National Riding days. We give Mr Weatherley credit for his good record and his admission of the breach and we believe that a penalty of 6 National Riding days is appropriate. 

We grant Mr Weatherley a deferment of his suspension pursuant to Rule 1106(2) until after the conclusion of racing on the 4th of January 2018.
