As the breach was admitted we find the charged proved.

Penalty:

After taking all of the above into consideration, the committee imposed a period of suspension of 4 days on Mr Colgan to commence after racing at Thames on 5 January and conclude after racing at Ellerslie on 12 January.

Facts:

Following the running of Race 8, an information was filed by Stipendiary Steward, Mr J Oatham against licensed jockey, Mr V Colgan alleging a breach of Rule 638(1)(d) in that he permitted his mount 'MAPMAKER' to shift inwards when not sufficiently clear, taking'OHOPE PRINCE' (M Sweeney) inwards, crowding 'WINE'NSODA' (S Spratt) onto the hindquarters of 'DARCI'S GOLD' (M Cameron) with 'WINE'NSODA' being checked near the 1300 metres.

Mr Colgan was present at the hearing and admitted the charge.

Submissions for Decision:

The subject race was over a distance of 1600 metres and started from a chute in the back straight. Mr Colgan's mount started from the middle of the field at barrier 8.

Mr Robinson demonstrated the available video films. He pointed out that shortly after the start 'MAPMAKER' was towards the middle of the track about 5 horses wide. The film showed Mr Colgan looking towards his inside and angling his mount inwards. In doing so, he takes 'OHOPE PRINCE' inwards which results in crowding onto 'WINE'NSODA' forcing Ms Spratt to attempt to restrain her mount. However, this movement caused 'WINE'NSODA' onto the hindquarters of 'DARCI'S GOLD' which was also checked. This interference took place at approximately the 1300 metres mark. Mr Robinson added that in his opinion Mr Colgan had been slow in 'pulling off' the other horses.

Mr Colgan had nothing to add when asked to comment.

Submissions for Penalty:

Mr Oatham told the Committee that Mr Colgan had a respectable record. He felt that the incident was an error of judgement on Mr Colgan's behalf and that he had taken immediate steps to correct his mount. He added that the Stewards felt the incident was between the low to mid range on the scale of seriousness. He added that it was to Mr Colgan's credit that he admitted the breach at the first instance, and that the matter could be dealt with by way of a suspension. He told the committee that Mr Colgan had incurred two suspensions for similar breaches in the past 12 months, on 13 October at Matamata (4 days) and 24 November (6 days, a Premier day).

When asked for his riding committments in the coming week, Mr Colgan stated that as he had been involved in a fall in an earlier race at the meeting he was unsure of his ability to ride at upcoming meetings. He said he would not be riding at Ruakaka the following day and was most unlikely to ride at Thames on 5 January although he had firm engagements. Mr Colgan was given time to contact his riding manager to check on his position regarding Thames and then told the committee he most probably would ride there.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions. We accept that Mr Colgan had admitted the breach and had attempted to correct the situation at the earliest opportunity. However, there were 3 horses affected by his actions. We concur with Mr Oatham that the incident fell into the low to mid range on the level of seriousness.

Regarding Mr Colgan's suggestion that he may not ride at the Thames meeting on 5 January the committee explained to him that if he did not ride there his period of suspension would start after that meeting regardless.
