For the reasons outlined above the committee is not satisfied that STORMING THE TOWER would have beaten PUMP UP THE VOLUME had interference not occurred.

Therefore the protest is dismissed and the judges placings shall stand.

The committee orders the payment of stakes and dividends accordingly.

Facts:

The Judges placings were as follows:

No 4     PUMP UP THE VOLUME     1st

No 2     STORMING THE TOWER    2nd

No 5     REACHFORTHESTARS      3rd

No 7     SKYE BUIE                         4th

No 10   COUPE DE VILLE                5th

The official margin between first and second was three quarters of a length.

Following race 5 a protest was filed pursuant to rule 642.  The informant Mr Bell alleged that PUMP UP THE VOLUME placed 1st by the judge interfered with the chances of his horse STORMING THE TOWER which was placed 2nd by the judge.  He alleged this interference occurred in the final straight. 

Submissions for Decision:

Mr Bell asked his jockey, Mr J Jago, to make the opening statement.  Mr Jago said that in the final stages of the race, Mr Innes, rider of PUMP UP THE VOLUME, had moved out from a position of approximately 6 horse widths inside him to take his line of running when the runners were approaching the 100 metre mark.  Mr Jago maintained he was always keeping a straight line but had to check and angle inwards when Mr Innes took his line.  He stated that without the interference he would have won by a neck or a head.

Mr Bell, trainer of STORMING THE TOWER said his horse was crowded which caused him to change ground.  He added that his horse then made up ground to finish half a length behind the winner.

Mr Coombe, part owner of PUMP UP THE VOLUME stated that his horse was not ridden out to the full extent because it was always going to win.  He said the films clearly showed that STORMING THE TOWER did not make up any ground on his horse in the final stages. 

Mr Innes, rider of PUMP UP THE VOLUME conceded he did come out for a stride but this did not cause Mr Jago to stop riding.  He said in the last 40 metres STORMING THE TOWER was not making any ground on his mount.

Mr Oatham when asked for his assessment of the interference conceded that STORMING THE TOWER did receive a check at the 100 metres. He said this forced Mr Jago to take a hold. However from then on it was clear that STORMING THE TOWER only made limited ground on the winner and he expressed the view that given the margin of 3/4 length at the line he had doubts as to whether STORMING THE TOWER could have won the race.

Mr Bell, in summing up, said his horse was severely checked and lost momentum for 5 to 6 strides. He believed this cost him 3/4 length and had Mr Jago been able to keep riding he would have won the race.

Reasons for Decision:

The committee carefully considered all the submissions and evidence and reviewed the video films.  We concede that STORMING THE TOWER  was checked for a stride or so at the 100 metres when his rider Mr Jago had to take a hold as a result of PUMP UP THE VOLUME taking his line.  However the films clearly showed that Mr Jago did not have to stop riding.  The committee also confirmed that in the last 50 metres in the run to the post STORMING THE TOWER was not making any appreciable ground on PUMP UP THE VOLUME.  The margin of 3/4 length between the 2 horses at the post was also a critical factor in the committee reaching its decision.
