As the breach was admitted we find the charge proved.

Penalty:

After taking all the above factors into account we impose a suspension of Miss Spratt's riding license which is to start after racing today 17 November and conclude after racing on 24 November (4 days).

Facts:

Following race 4 Mr M Williamson filed an information alleging a breach of rule 638 (1) (d).  He submitted that Miss S Spratt allowed her mount POSTMAN'S DAUGHTER to shift in when not clear of MISS DANNI (C Lammas) which had to check. 

Submissions for Decision:

Mr Coles demonstrated the video films and pointed out POSTMAN'S DAUGHTER racing 3 off the rail approaching the 200 metre mark.  Approximately 1 1/4 lengths ahead and inside her was JOEY MASSINO (Miss D Johnson).  Directly behind JOEY MASSINO was MISS DANNI.  At this point JOEY MASSINO was observed to move outwards and into the line of POSTMAN'S DAUGHTER.  Mr Coles submitted that Miss Spratt angled in to obtain clear running taking the line of MISS DANNI when not the required distance clear.  This resulted in MISS DANNI having to be checked for 2 strides.

Miss Spratt submitted she was going for a run inside JOEY MASSINO and while admitting the charge believed that Mr Lammas riding MISS DANNI had overreacted.  She said in her opinion Mr Lammas could have stayed where he was. 

Submissions for Penalty:

Mr Williamson told the committee that if Miss Spratt had indeed had her line dictated to her obligation was to take a hold and not angle in for a better run.  However he submitted the breach was at the low end.  He produced Miss Spratt's record which showed 4 careless riding breaches in the last 12 months.  He added she had not had a charge in the last 5 months which he said was a good record.

Miss Spratt told the committee she did not having any firm commitments after today's racing but did ride throughout the country.  She said she intended to ride at Winton on 21 November if her manager could obtain rides on her behalf.

Reasons for Penalty:

The committee carefully considered all submissions and evidence.  In regard to Miss Spratt's proposed engagements at Winton on 21 November the committee told her that before taking this date into account it required confirmation from her Manager, Mr M Brown, that he had secured rides for her.  The hearing was adjourned to allow her to contact Mr Brown who was instructed to speak to Mr Williamson regarding the engagements.  On resumption of the hearing Mr Williamson confirmed to the committee that Mr Brown had contacted him saying that there were mounts available for Miss Spratt at the upcoming Winton meeting. 

Regarding the charge itself the mitigating factors are Miss Spratt's admission of the breach and the contribution to the incident by JOEY MASSINO who moved out taking the gap Miss Spratt intended to move into.  However this does not excuse Miss Spratt angling her mount in when insufficiently clear of Mr Lammas and she was found to be in breach of rule 638 (1) (d).  There were no concessions given for Miss Spratt's record as she has incurred 4 suspensions in the last 12 months.  The committee does find the breach to be at the low end. From a starting point of 5 days and giving consideration to the mitigating factors described we find an appropriate suspension is one of 4 days.
