Facts:

Following the running of Race 3 (Waikato Branch NZ Farriers Assn 1400), Information A. 12949 was filed with the Judicial Committee.

The Informant, Mr Ormsby claimed that SWEET HUNTER interfered with the chances of his mount RED HUSSAR.

The alleged interference occurred in the final straight.

The Judge’s Placings were as follows:
1st-No.13 -SWEET HUNTER
2nd-No.1 - RED HUSSAR
3rd-No.14 - ZEE FALLS
4th-No.8 - CHAMPAGNE PRINCESS

The official margin between 1st and 2nd was a Head.

All connections present acknowledged that they understood the Protest Rule.

Submissions for Decision:

Mr Ormsby said that SWEET HUNTER who was in the lead came out at the 70–50m mark and affected his momentum. He said that he came from 3 lengths behind SWEET HUNTER, when it veered out and affected his momentum. He said that his horse was superior to the winner.

Mr Richardson said that it was only a head margin and that the interference cost his horse winning the race.

Mr Ritchie said that the key point was that Mr Ormsby was able to continue riding his horse and did not stop asking his horse to go forward.

Mr Goindasamy said that his horse was green and tried to run off the rail, it was wandering along a bit, when it saw the winning post and it ran out the last bit. He estimated it shifted two to three horse widths but there was not any contact.

Reasons for Decision:

The Committee carefully considered all the submissions presented and reviewed the video footage both head and side-on.

The Committee found that near the 70-50m, RED HUSSAR was finishing strongly, then when up on the outside of SWEET HUNTER, that runner veered outwards abruptly forcing RED HUSSAR off its rightful line of running. As a consequence of that shift RED HUSSAR lost momentum. From there on RED HUSSAR was observed to finish strongly to be beaten by a head.

The Committee was comfortably satisfied that if such interference had not occurred that RED HUSSAR would have finished in advance of SWEET HUNTER.
