Mr Goindasamy’s Apprentice Jockey’s Licence was suspended from the end of racing on 21 October through to the end of racing on 29 October 2020 (6 Riding Days).
Facts:
Following the running of Race 3 (Waikato Branch NZ Farriers Assn 1400), Information No. A12950 was filed with the Judicial Committee. It was alleged that Mr Goindasamy allowed his mount SWEET HUNTER to shift out when not sufficiently clear of RED HUSSAR which was hampered passing the 50m.
Mr Coles showed the film replays and indentified the horses and riders involved.
His submission was that early in the straight Mr Goindasamy had his whip in the right hand, then shifted the whip to his left hand and then near the 100m shifted it back to his right hand. He added that when hit with the whip, his mount shifted out from the running rail and then he hit it again whilst it was shifting out. He said that in his opinion it would have been better if Mr Goindasamy had not shifted the whip back to his right hand.
Mr Harris said that the biggest mistake made was when Mr Goindasamy changed his whip hand. He said that his mount only shifted when struck with the whip the second time. He felt it would have been better if he had given his mount a couple of slaps on the shoulder. He concluded by saying that Mr Goindasamy did try hard to straighten his horse up.
Submissions for Penalty:
Mr Jones said that Mr Goindasamy had four prior breaches of the Rule in the past 12 months, with the most recent being on 18 July 2020. He said that in his opinion the record was a neutral factor. He placed the carelessness in the low-range. He added that Mr Goindasamy is a young Apprentice who was trying hard to win. He concluded by saying that an aggravating factor would be that his mount was relegated from first placing.
Mr Harris submitted that Mr Goindasamy’s record had improved in recent times, that he was currently the leading Apprentice in New Zealand and that he had improved immensely in all aspects in recent times.
Mr Goindasamy asked for any suspension imposed be deferred by 7 days.

Albeit Mr Goindasamy’s mount was relegated from first to second, it was the Committee’s opinion that the carelessness displayed was in the low-range category. The JCA Penalty Guide starting point for low-range carelessness is a suspension of 6 riding days, which was adopted. A discount of 1 day was given for the admitted breach, with an uplift of 1 day due to the relegation.
