Facts:
Following the running of the O'CONNOR WARREN INSURANCE BROKERS MAIDEN an Information was lodged by Stipendiary Steward Mr B Jones against Apprentice Jockey Mr C Jones alleging that Mr Jones used his whip excessively prior to the 100 metres mark.
Rule 638(3)(b)(ii) provides: a Rider shall not strike a horse with a whip in a manner or to an extent which is excessive.
The revised Whip Guidelines that came into force on the 1st of October 2020 provide that there is a limitation of 5 strikes with the whip prior to the 100 metres mark.
Mr Callum Jones was present at the Hearing and he advised the Committee that he understood the Rule and the Whip Guidelines and that he admitted the breach. Mr Jones was assisted by Apprentice Jockey's Mentor Mr N Harris.
Stipendiary Steward Ms V Algar demonstrated the incident by use of the race films. She identified Mr Jones riding CASSIO and showed where Mr Jones used his whip 9 times prior to the 100 metres mark.
Mr C Jones agreed with the number of strikes with the whip.
Submissions for Penalty:
Mr B Jones said that Mr C Jones had not breached this Rule in the last 12 months and under the Whip Guidelines a fine of $300.00 should be imposed.
Mr C Jones is aware of the Guidelines and the prescribed starting point penalties.
Reasons for Penalty:
The breach is admitted and this was inevitable given the very clear film evidence. Mr C Jones has not breached this Rule in the previous 12 months and in that event the Whip Guidelines prescribe a starting point penalty of a fine of $300.00.
The Committee pointed out to Mr Jones that for a second breach of this Rule the starting point penalty would be a $500.00 fine and a 3rd breach would attract a suspension of Licence. There are also special Rules for Group and Feature races.
