Mr Lammas was informed that the JCA penalty guide called for a starting point of 5 days suspension for a breach of this type. His good record and early admission were to his favour.

Accordingly we imposed a period of suspension of (4) days, beginning after racing at Ellerslie on 16 December, and concluding after racing at Ellerslie on 26 December 2012. The meetings involved are:

Matamata       (19 December)

Levin              (20 December)

Waikato          (22 December)

Ellerslie          (26 December)

Facts:

Following the running of race 6 an information was lodged by Stipendiary Steward Mr A Coles against Class A Jockey Mr C Lammas alleging a breach of Rule 638(1(d) in that he permitted his mount 'ROSE OF FALKIRK' to shift outwards when not sufficiently clear of  'WING NAPRAYER' which was checked near the 350 metre mark.

Mr Lammas was present at the hearing and admitted the breach.

Submissions for Decision:

The subject race was over a distance of 1400 metres, and the alleged breach occurred in the final straight at about the 350 metre mark.

Mr Oatham demonstrated the video films of the race. He told the Committee the incident began on the final turn into the home straight. Mr Lammas' mount 'ROSE OF FALKIRK'  was adjacent to the running rail and as the field progressed the horse shifted away from the running rail into a 2 wide position. That movement did not cause any problem to other horses, however as the field passed the 400 metre point 'ROSE OF FALKIRK' shifted out further into the path of 'WING NAPRAYER'. At this point the rider of 'WING NAPRAYER', Mrs L Satherley, was forced to check her mount as she could not go outwards due to the close proximity on her outside of 'SWIPER THE FOX' (Mr L Innes). Mr Innes maintained his line as he was entitled to, which further inconvienienced Mrs Satherley.

Mr Lammas acknowledged to the Committee that his mount had rolled out, however he considered it had taken place slowly and over a considerable distance. He said that he heard Mrs Satherley calling out to Mr Innes and Mr Lammas said he thought the pressure on Mrs Satherley was coming from the horse on her outside. However, to his credit, he then stated that he had clearly rolled out and accepted responsibility for the incident.

Reasons for Decision:

As the breach was admitted the charge is proved.

Submissions for Penalty:

Mr Coles submitted that the incident was clearly demonstrated on the video films. He said that Mr Lammas had a very good, record and that it was to Mr Lammas' credit that he had admitted the breach. He had been suspended 3 times within the past 12 months for similar breaches, namely:

24 October     (4 days)

6 November   (5 days)

10 November (5 days)

Mr Coles submitted that the incident fell into the lower to mid range on the scale of seriousness.

Mr Lammas told the Committee that he rode mainly in the North Island. He asked that the period of suspension commence after racing at Ellerslie on 16 December 2012. He did not have any confirmed rides at Matamata on 19 December.

Reasons for Penalty:

The Committee considered all the submissions and the evidence of the video films as presented. The Committee accepted that the breach was in the low to middle range in the scale of seriousness, and acknowledged Mr Lammas to be a busy and generally safe rider. His early admission was also a mitigating factor in determining an appropriate penalty.

It was difficult to assess the effect the interference to 'WING NAPRAYER' had relative to its finishing position which was 6th, some lengths from the first horse.
