After taking all of the above into consideration, and adopting the JCA penalty guidelines which for a careless riding charge calls for a starting point of 5 days, we accept Mr Grylls' admission and his very good record in the past 12 months. Accordingly we impose a period of suspension of (4) days.

Regarding Mr Grylls' evidence that he has 7 confirmed rides at Matamata on 19 December, we find no reason to deprive the connections of those horses of Mr Grylls' services, and the suspension will commence after racing at Matamata on 19 December and finish after racing at Ellerslie on 26 December 2012.

Facts:

Following the running of Race 5 an information was lodged  by Stipendiary Steward Mr A Coles against Class A rider Mr C Grylls alleging a breach of Rule 638(1)(d) in that he permitted his mount 'WAITOKI FLOWER' to shift inwards when not sufficiently clear of 'SECRET'S ONLY' which was forced inwards crowding 'LADY EIKO' onto 'POSH TIGER' near the 250 metre mark.

Mr Grylls was present at the hearing and admitted the breach.

Submissions for Decision:

This race was over a distance of 1400 metres, and the breach of the relevant rule was alleged to have taken place approximately 250 metres from the finish.

Mr Oatham demonstrated the video films which showed that at the top of the final straight 'WAITOKI FLOWER' ridden by Mr Grylls was being ridden forward with the whip. On his inside was 'SECRET'S ONLY' ridden by Miss Johnson. As Mr Grylls was riding his mount forward it commenced to shift inwards, putting pressure on' SECRET'S ONLY' which reacted by shifting inwards onto 'LADY EIKO' ridden by Mr Colgan. 'LADY EIKO' was then put into a bad situation and blundered putting pressure on the horse inside it, 'POSH TIGER' ridden by Mr Dye. As a result of this pressure 'POSH  TIGER' was turned sideways. This occurred at approximately 250 metres from the finish. Mr Oatham added that it was his opinion that 'SECRET'S ONLY' had over-reacted to the pressure from its outer.

Mr Grylls then attempted to straighten his mount, however during this time he had moved inwards between 1 1/2  and 2 horse widths. Mr Oatham submitted that Mr Grylls had been too slow to react to his mount's inwards movement and in doing so had put pressure onto the 3 horses inside him.

Mr Grylls had nothing to add when asked to comment.

Reasons for Decision:

As the breach was admitted we find the charge proved.

Submissions for Penalty:

Mr Coles told the Committee that Mr Grylls had an excellent record, and that the only suspension in the past 12 months was on 2 November 2012 ( 5 days ). He said that Mr Grylls was a busy rider and could be given credit for his early admission. He felt the breach fell into the mid to lower end of the scale of seriousness, and called for a period of suspension.

Mr Grylls said that he had commitments at Palmerston North the following day, and at Ellerslie on 16 December. When asked about his commitments at Matamata on 19 December he stated that he had 7 confirmed rides but felt that he could be released from them and would like his suspension to begin after racing at Ellerslie on 16 December.  He added that he often rode at Ashburton and could have commitments there.

The Committee considered the evidence shown per the video films and the submissions from Mr Coles.

This incident could have had quite serious consequences as there were 3 horses and riders affected as a result of the inwards movement. We accept that Miss Johnson's mount may have over-reacted to the pressure from Mr Grylls, and that Mr Grylls attempted to straighten his mount, however we agree with Mr Oatham that the 'damage' had been done by then. The Committee is of the opinion that the breach is in the low to mid range on the scale of seriousness, tending towards the middle of that range.
