After taking the above matters into consideration and adopting the JCA guidelnes which call for a starting point of 5 days suspension for a careless riding charge, we accepted Mrs Allpress' admission during the hearing which is to her credit. Her record during the previous 12 months is a good one for a rider who competes on an almost daily basis throughout the country.

Accordingly we imposed a period of suspension of 4 days which is to begin after racing on 21 December and conclude after racing on 27 December 2012.

On being told of the period of suspension, Mrs Allpress expressed surprise and asked to be allowed to contact her riding manager. She was given permission to do so, and when she returned before the Committee stated that her manager had 'got her off' her engagements at Matamata, Levin and Ashburton and that she wished to start her suspension earlier.

Mrs Allpress was informed by the Committee that she had been adamant in her evidence that she had firm commitments to ride at Matamata, Levin and Ashburton and that her penalty had been assessed accordingly. The Committee felt that there was no reason to deprive the connections of those horses of her services and that the original penalty would stand.

Facts:

Following the running of Race 3 an Information was lodged by Stipendiary Steward Mr A Coles against Class A Rider Mrs L Allpress alleging a breach of Rule 638(1)(d) in that she permitted her mount 'HERMAN' to shift outwards when not sufficiently clear of 'GRANADA' which was checked near the 500 metre mark.

Mrs Allpress was present at the hearing. She initially denied the breach, however during the presentation of evidence being given by Mr Oatham per the video films, she interrrupted the hearing and requested that she be allowed to alter her plea and to admit the breach. The information was duly amended and signed accordingly by Mrs Allpress.

Submissions for Decision:

Mr Oatham demonstrated the video footage available which showed that at about the 600 metre mark, 'HERMAN' (Mrs Allpress  was near the running rail about 3 horses from the lead.  On her outside 'GRANADA' (Ms Spratt) was being ridden with the whip to hold its position. HERMAN was on the heels of the horse immediately in front of it and attempted to improve its position by forcing an outwards movement but at that time was being held in-quite correctly-by GRANADA which was racing alongside it. Mrs Allpress then angled HERMAN's head outwards and rode her mount forward into a 3 wide position on the outside of GRANADA. It was clearly evident on the film that this caused a check to GRANADA, and Mr Oatham submitted that HERMAN was never clear enough to move forward without causing the interference. At about the 500 metre mark Ms Spratt had to check her mount off the heels of HERMAN and that is where the breach of the rule occurred. At that time the horse ASTANA ridden by Mr O.Bosson was in a 4 wide postion outside GRANADA and was moving forwards. Mr Oatham stated that ASTANA did not contribute to the incident.

Mrs Allpress stated that she was aware that Ms Spratt's mount alongside her was under pressure and was 'going nowhere', and that she believed that it gave her an opportunity to improve her mounts position. She stated that Ms Spratt was using the whip on her mount and it was not responding. She said that initially she didn't realise that she alone had caused the interference to GRANADA, and that there had been inwards pressure from Mr Bosson, however on viewing the films had recognised that she was responsible, hence the decision to alter her plea.

Mrs Allpress asked that she be allowed to call Ms Spratt to give evidence on her behalf.

Ms Spratt told the Committee that at about the 600 metre mark her mount GRANADA was under pressure to hold its position, and that she was using the whip on it. She said that the incident shortly after when HERMAN crossed in front of her did not affect her chances of finishing in a better position. In response to a question from the Committee she said that her mount had not been travelling well enough to hold its ground, and that while it was 'running around' a bit there had been no pressure from any horse outside it.

As the breach was admitted we find the charge proved.

Submissions for Penalty:

Mr Coles told the Committee that Mrs Allpress was a very busy rider with a good record. She had received 3 periods of suspension within the last 12 months, being 27 December 2011 (6 days), 1 September 2012 (4 days) and 23 November 2012 (6 days). He said she was considered an international rider and rode in both the North Island and the South Island. He stated that the Stipendiary Stewards had assessed the incident as being in the low to middle level on a scale of seriousness.

Mrs Allpress stated that she felt the incident was at the low end on the scale of seriousness. She felt it was 'minor' interference to Ms Spratt and that it had made no difference to her finishing position. Regarding her upcoming engagements, Mrs Allpress told the Committee she had firm commitments at Matamata on 19 December, Levin on 20 December and Ashburton on 21 December 2012, and that she was particuarly keen to fulfill her commitments at Asburton and would ask that any suspension begin after that meeting. When questioned about her intention to ride at Ashburton Mrs Allpress reaffirmed her desire to do so.

The Committee considered the submissions made by the parties to this hearing, and took notice of the incident as shown on the films available. The Committee acknowledged that Mrs Allpress had eventually admitted the breach after viewing the films. However it was pointed out to Mrs Allpress that the fact that the affected horse had not been travelling well did not give her any authority to ignore her obligations to other riders, and that the Committee was of the opinion that she had displayed a degree of intent to commit a breach of the rules when angling her mount outwards across Ms Spratt's horse. The two horses were racing side by side at the time and Mrs Allpress would have known that her outwards movement at that point was likely to cause Ms Spratt's mount to be checked but elected to 'come out' regardless.
