After taking all the above matters into consideration, and adopting the JCA guidelines of 5 days suspension being the starting point, we also accept Mr Cameron's admission and accept that he is a very busy rider with a good record.

Accordingly we impose a period of suspension of (4) days, which is to begin after racing on 17 December and conclude after racing on 22 December 2012.

The meetings concerned are:

Matamata   (19 December)

Levin          (20 December)

Ashburton  (21 December)

Te Rapa      (22 December)

Rule 1106(2) applies in respect of Mr Cameron's commitment/s on 17 December 2012 at the Gore race meeting.

Careless Riding

Facts:

Following the running of Race 2 an Information was laid by Stipendiary Steward Mr A Coles against Class A Rider Mr M Cameron alleging a breach of Rule 638(1)(d) in that he permitted his mount 'MANDY O'REILLY' to shift inwards when not sufficiently clear forcing 'BRISAYUS' inwards crowding 'MADLY BENTLEY' which was checked near the 1200 metres.

Mr Cameron was present at the hearing and admitted the breach.

Submissions for Decision:

This race was over a distance of 1300 metres and started towards the start of the back straight which affords riders ample time to position their mounts prior to entering the first corner.

Mr Cameron was riding 'MANDY O'REILLY' which started from an outside barrier position.

Mr Oatham demonstrated the video films and identified the horses and riders involved. He pointed out that 'MANDY O'REILLY' was being ridden vigorously forward by Mr Cameron after the start. The horse was in a 3 wide position and shifted abruptly across into the line of 'BRISAYUS' ridden by Mr Coleman, which caused 'BRISAYUS' to be checked and subsequently crowd 'MADLY BENTLEY' (Miss D Johnson). Mr Oatham stated that Mr Cameron was not the required distance clear of 'BRISAYUS' when he started to shift across to gain a better postion.

He added that there was slight contributing movement inwards from 'BRISAYUS'.

Mr Cameron agreed that he had been riding vigorously forward and that he had put a 'little bit' of pressure on Mr Coleman's horse.

Reasons for Decision:

As the breach was admitted we find the charge proved.

Submissions for Penalty:

Mr Coles stated that Mr Cameron was a busy rider who travelled a lot and rode throughout the Country. He felt that the rider had a good record given the number of races he rode in. Mr Coles read out Mr Cameron's record during the previous 12 months:

23/1/2012 (4 days), 3/3/2012 (6 days and $1000 fine), 3/3/2012 (7 days, $1200 fine), 27/8/2012 (4 days).

Mr Coles felt the incident was towards the lower to mid level on the scale of seriousness, and that Mr Cameron should be given some credit for his early admission.

When questioned about his upcoming engagements Mr Cameron stated that he had been engaged by his manager to ride at the Gore meeting on 17 December and wished any suspension to commence after that meeting.

Reasons for Penalty:

The Committee considered the submissions of the parties and the evidence presented per the video films.

We take into account that the incident took place shortly after the start of the race, however in our opinion Mr Cameron had shown some disregard towards runners inside him when attempting to position his mount in a forward position. While there may have been some movement by 'BRISAYUS' there is no doubting the culpability lies with Mr Cameron. It would not be possible to state that any horses' chances of finishing in a better position were disadvantaged, however the riders involved may have had their own plans for their mount's positioning  affected.

The Committee agrees with Mr Coles that the incident fell towards the lower end of the scale of seriousness.
