Facts:
Following the running of race 2, United Gaming Ltd 3yo, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Ms Gatu, alleged that CAMEAHOTFRIDAY or its rider placed 1st by the Judge interfered with the chances of her mount MOTUMAN placed 2nd by the Judge.
The interference was alleged to have occurred in the final straight.
The Judge's placing are as follows:
1st No. 1 CAMEAHOTFRIDAY
2nd No. 6 MOTUMAN
3rd No. 2 ROGER THAT
The official margin between 1st and 2nd was a long head.
Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.
All connections present acknowledged they understood the Rule.
Submissions for Decision:
Ms Gatu submitted that near the 50 metres CAMEAHOTFRIDAY dictated her horse out a little. She said there was a bit of contact between the 2 horses near the finish line. She added given the small margin at the finish she believed MOUTUMAN could have beaten CAMEAHOTFRIDAY if she had a clear run to the finish line.
Mr Manning said the alleged incident is pretty straightforward. He identified the outward movement by CAMEAHOTFRIDAY is slight and stated you can’t say that MOTUMAN would have beaten CAMEAHOTFRIDAY.
Mr Nor Azman submitted that CAMEAHOTFRIDAY did shift out by a very small margin near the 50 metres but felt MOTUMAN had its chance to win the race.
Mr Carter, the trainer of MOTUMAN, did not present himself at the hearing despite the Stewards advising him of the protest.
Mr Harris was given the opportunity to represent Mr Carter.
Mr Harris submitted that the interference occurred in the final 50 metres and believed the protest did have some merit. He said any interference is relevant in trying track conditions.
Mr Oatham identified on the video films that near the 50 metres there is a bit of a shift from CAMEAHOTFRIDAY. He said MOTUMAN is forced over little extra ground but is of the view this did not result in any direct interference to MOTUMAN. He identified that Mr Nor Azman did straighten his mount and the contact occurred right on the winning post. He submitted that the Stewards struggle to support the protest.
Reasons for Decision:
The Committee carefully considered all evidence and submissions presented and reviewed the video footage several times. The Committee accepts that CAMEAHOTFRIDAY did shift out slightly inside the final 50 metres. This resulted in MOTUMAN being shifted out momentarily prior to Mr Nor Azman straightening up his mount. The films confirmed that CAMEAHOTFRIDAY is holding a comfortable margin over MOTUMAN in the run to the finish line. The Committee is of the opinion that the minor interference that occurred did not have a bearing on the outcome of the race. Accordingly there are insufficient grounds to justify a change of placings.
After taking into account all the above factors the Committee is not satisfied that MOTUMAN would have beaten CAMEAHOTFRIDAY had such minor interference not occurred.
