Following race 7 Mr N Goodwin filed an information pursuant to rule 638 (2). He alleged that Miss Johnson made a celebratory gesture on LADY CHAPARAL prior to the winning post.
Submissions for Decision:
Mr Williamson demonstrated the video films and pointed out to the committee Miss Johnson raising her left hand in a celebratory gesture prior to the winning post. He said it was not an extravagant breach of the rule but clearly was unacceptable.
Miss Johnson said in admitting the breach it was clear on the film that she had made an error of judgement.

Mr Goodwin said Miss Johnson had no previous breaches under this rule. He said her actions were not extravagant and submitted a fine of $200 would be appropriate.
Reasons for Penalty:
While the committee finds the breach proven we believe Miss Johnson's actions were at the low end of carelessness. This was her first charge under this rule which would normally have incurred a $150 fine. However as this occurred in a group 3 race a higher penalty is justified.
